    Question for LEOs about retreiving seized firearms

    Long story short, had a couple guns unrelated to an incident get collected by LE.

    It has been some time that they've been in custody and I'd like to get them back since the case has long been concluded (not related at all with me but someone I was living with at the time). I reached out to a Dep. DA who had given me their card during the whole thing, waiting on them to get back to me, but want to know what to expect about the process of retrieving my property.

      Best to contact the LE agency directly and learn if they're available for release.

      If so, you'll need to complete the release process specified in Penal Code section 33850. But that process only authorizes the release, it does not direct the agency to release.

      Additionally, please note that LE agencies will normally only hold firearms for a period of 180 days without having contact from their owner. After that time, they are normally destroyed as abandoned under Penal Code section 34000.
