There is a plethora of information on this forum for trial by declaration. If you try the "search" option; you will bring up several pages to keep you reading for a long time.

I did it recently (in LA County) and won the case.

It increases your chance of beating a ticket to 50-50 instead of just rolling over and playing dead. You'll have to cough up the money first, but if the judge rules in your favour, you get the money back.

I get as many extensions as possible prior to filing my TBD. Drag it out. Put as much time between you and the officer's memory as possible.

Now, to be honest, my wife's mother is a judge in Ventura County and she tells me that the reason most people win TBD is because the officer doesn't submit his argument.

Essentially your facts don't matter if there is an opposing view from the LE Agency that issued the ticket.

But you can't win of you don't play.

Coming to the LEO forum to basically ask a leo to give his/her opinion of whether you can beat a ticket by TBD is not only rather silly, it is also rather naive.

Please do what Fire in the Hole suggested and do a search; you will find a lot of suggestions and opinions in the Off Topic forum.

            READ THESE RULES BEFORE POSTING!
            1. This forum is for Calguns LEO members and those who would like to ask questions in a civil manner.

            2. This forum is to give our LEO members a place to share their stories, pictures and videos as well as answer serious questions from the membership.

            3. This is NOT a place to air your dislike of the Government, Law Enforcement, LEOs in general or the law in general. Doing so here will result in losing access to this forum.

            4. Post denigrating or insulting our LEO members will be removed and the poster will no longer be able to access this forum.

            5. Questions for LEOs should be both civil and serious. Questions like 'Why do you thugs..' will get you removed and possibly banned. Frivolous questions will be deleted.

            6. 'Cop Bashing' will NOT be tolerated in this forum at all.
His questions are frivolous for this particular forum. Tho he is asking it civilly, as I said, to expect a leo to give him advice about the process of circumventing a ticket is silly and naive; it won't happen.

There are numerous and I mean numerous, threads/posts about TBD in the OT forum, a more appropriate forum for his particular needs in this case. This is not the forum for that.

Rather than just delete the question, I sent him a pm with some pm only info and then posted here.

retired doesn't need my help, but imagine going onto the IRS Forum, and asking the IRS Agents how to beat an audit. There are lots of forums run by Tax Attorneys and CPA's that offer such advice, and their services. In short, there are appropriate and inappropriate forums to share the same information.

Trial by Declarations have been discussed ad nauseam on the Calguns Off- Topic area. Quite recently in fact. This would be the appropriate place to do such a search.
