    Question on DUI for CA LEOs

    My wife hired a guy to paint one of our places out in the country and I subsequently learned this guy has about 10 DUIs. How on earth does a guy keep getting DUIs?? At some point I would think that his ability to apply for and get a CA DL would be impossible.

    Is a DUI a felony?

    1) As long as a person is not in custody, and has access to a vehicle, they can keep getting more DUI's

    2) You don't gotta have a Driver's License to get more DUI's. A lot of "Career Offenders" lost their licenses long ago, but that don't stop them from driving and adding to their DUI scorecard.

    3) DUI can be a felony or a misdemeanor, depending on the circumstances. One be charged with felony DUI if they are involved in a collision that results in bodily injury to another. One can also be charged with a felony for their fourth DUI within a ten year period.

      Thank. Nuts. clearly, anyone with ten DUI convictions appears to have a significant problem!

              don't need a DL to rack up multiple DUI's. all one requires is access to a vehicle and alcohol.

                I popped a guy for DUI on his way home from court for ....DUI. He had several others. His attorney kept getting continuances, until the oldest DUI timed out, then he plead. Good money maker, took several years, never had to testify.

                  System is broken. All DUI's should be charged the same. Just because you get popped before you kill someone doesn't mean you should get off any easier.

                    Yup. I stopped a guy on his way to meet his attorney for DUI trial. Asked him how many he had to drink and he replied ''Once, doce.'' His wife was sitting next to him in the passenger seat. Family in the back. I asked her why he was driving & she replied he would not let her. He was the only person I ever arrested for DUI who answered honestly.

                          Negative. Blowing a .08 a block from home IS NOT the same as hitting a school bus with .19 on board. It just isnt.

                          MAD inserted itself into the legislative process and has tried to ban social drinking outside the home.

                          I am always the DD and always drink water or tea when out, because i have a law license and a ccw.

                          But a 240lb guy who has two beers in an hour and a half is not impaired, and habitual drunk drivers are not blowing .08s. Watch the alcohol level when there is a gnarly accident with injuries. Its never .08.

                          Also, we dont charge robbery the same as armed robbery, the bumper sticker ?they havent killed anyone yet? is impaired thinking. The punishment is supposed to fit the crime, not what your imagination thinks the crime might be later.

                            It used to be, and I've been out for a long time so it may have changed, that after getting more than 3 in a certain period of time, the 4th, and subsequent, can be filed as a felony. No accident needed, just a simple DUI can be a felony.
