    CCW Question

    I have been feeling a bit apprehensive about applying for a CCW due to some criminal history in my early adult life. I have attached photos. If I am denied I believe this will be the reason. I took the ccw class and filled out the application in 2020 and never applied out of not wanting to be denied. I took it again this year and I have everything ready to turn in. I believe I am responsible enough now to accept the responsibilities that come with carrying a firearm. Do I have any chance of obtaining a concealed weapons permit with this history? Let me know your honest opinions.

          That was a background check for an elder care position. The last time I was arrested was 2004 I was suspected of being under the influence. I was tested all test came back negative and the case was dismissed.

            With your criminal history, I personally wouldn't issue you a library card. No offense, but I have to be honest.

                felony conviction for firearms theft. You can not possess firearms.

                  1/25/2001 conviction for pc 487 D on 3/8/2019 conviction reduced per pc17b and dismissed per pc 1203.4. I own several.

                    I would think the following subsection of 1203.4 PC applies:

                    (2) Dismissal of an accusation or information pursuant to this section does not permit a person to own, possess, or have custody or control of a firearm or to prevent conviction under Chapter 2 (commencing with Section 29800) of Division 9 of Title 4 of Part 6.

                    I?d have to look at my notes, but I don?t believe dismissal per 1203.4 restores gun rights. There are multiple ways to get records and cases reviewed/dismissed. Only a few restore gun rights.

                    ?then probably consult a lawyer since you just admitted to owning several firearms in a public forum, and are probably still prohibited.

                      You've filled out the paperwork and took the class. You can sit here and wonder if you'll get approved, or you can turn everything in and get a definite answer. Just being honest here....

                        GizmoSD-The 17b reduced the felony to misdemeanor-For all purposes. The 1203.4 will change the conviction or plea to "not guilty" & will close the case.

                          But does it restore gun rights? IIRC, I don?t believe 1203.4 does. The DOJ firearms class specifically mentions reductions/dismissals and how there are a few methods that don?t restore gun rights.

                            1203.4 by itself does not. However, if the charge was reduced, via 17b, it will usually result in restoration of firearm possession.

                            A California Penal Code § 17(b) motion is where you ask the court to reduce a felony offense to a misdemeanor. This is only possible if the felony is a wobbler.

                              ^^^ I’m with 1audio on this one. Nothing personal, it’s just you made too many bad decisions in life and I’d say an IA will make an easy decision on your application. “Denied.”

                              It is what it is. I truly hope that you did turn your life around and I believe if you’re serious, you deserve a second chance. …but not a ccw at this stage in your life.
