Automatic knives LEO exemption
Collapse

As stated by others, there is no legal statute that expresses or articulates LE exemption for an automatic opening knife.
Knife laws are interesting and there are many different laws restricting different things at different times. Im not able to take the time here to provide or reference specific sections but here's my general paraphrased description. You can not import into the state, buy, or sell a switchblade over 2", but its possession within your home is not prohibited. Prohibitions do come into play as separate sections restrict transport (carried in a vehicle) or possession within a public building or public space.
Basically, as long as you are not a restricted person based upon specific criminal convictions, any person could safely possess one in their home ( but unknown how they would legally obtain it). Once they leave their residence, than that possession is restricted. Again no stated exemption for LE. I would say there are many knife related laws that are antiquated and in need of future assessment.
Several large LE agencies I know do have specific policy restrictions that prevent their officers from carrying a concealed fixed blade (dirk or dagger) but do not make any statements for or against automatic knives. Basically they may carry a fixed blade on belt or uniform but it must be visible and not concealed. So, visible on their belt or external vest carrier is fine but in their boot or otherwise concealed is against policy and possibly against the law.Comment

Frozen in 2015, it is falling out of date and I can no longer edit the content. But much of it is still good!Comment

2nab hit the nail on the head when it comes to dept policy.
My agency policy restricts fixed blade or automatic knives, so I don't carry one while on duty with the PD. You should check with your specific agency policy even more so now that public opinion is against us should you be involved in either a use of force or even a mishap and you submit for qualified immunity or a summary judgement.Comment
