    Following Orders Question

    I saw someone link to this video:


    If the police or national guard give you a directive such as "get in your home" or "get inside now" are compelled to do that on your own front porch? Are they within their authority to pelt you with whatever non-lethal projectile was shot?

    I don't know if this is a general LEO question, but that particular tweet referenced MPD and National Guard. I couldn't tell who was doing what.

    Lucky they were just kids and not grown men defending the neighborhood. They would have been covered from other roofs and that street is a pinch point. How are the people upstairs to know that was less then lethal? I heard get inside! I’m hit!

        Honestly I don't know if they have declared Martial law in that area or not, but if they have and, there is a solid curfew order in effect then it could be acceptable, not smart. There are a lot easier ways to get people to comply than paint balls when they aren't a direct threat. That being said the video doesn't give whole lot of perspective of what the other people on the porch were doing either, that drew the attention of everyone.

          Do you happen to know which Dept is referenced as "MPD"? Is this in Minneapolis?

            You have to differentiate between military and law enforcement first, becuae their use of force or engagement protocols are diffrerent. Police use of force is guided by the 4th ammendment more specifically graham v connor. So any use of force wiuld have be legitimate based on rhe aforementioned. Technically a threat of some sort has to be articulated to use force such as a rubber ball...
