    Question about Phantom infraction

    Good afternoon,

I received a ticket, the first one I have had in 12 years, all the way back in early September. I never received a letter in the mail with the bail amount, court date, etc. I have search the County Superior Court every week, inputing DL, Citation number, etc and there is no record of this violation anywwhere...

What happened here in your experience or estimation? Did the officer after I bailed, decide to not turn it in, rip it up or let me go? Did the court screw up? Looking for some insight and what I am supposed to do as I'd rather not have to go to court, take a day off just to find that it never got turned in and they have record of it.... I understand obviously that would be good.

Ticket was given to me, I signed it and went about my day but I have never had this experience where there is literally no record of it anywhere. Any ideas?

    Thx in advance.

I have had a parking ticket completely vanished off the system because I think the officer realized that it was written in error, which it definitely was.

Which seemed a little strange because I thought the old "ripping up" of tickets by the officer writing them was now frowned upon...

    except for in the movies.

Your best bet is to call the court, the number should be on the citation, and see if they have any info on it. You do not want to find out the hard way that you have a warrant for FTA.

Are you sure t wasn’t a written warning?
Yeah it's a ticket with the "Notice to Appear" Traffic box ticked, and video box ticked? Weird. The ticket was issued in Sept. for an appearance date in early December. Funny thing is there is a dash across written by the officer through the 'time' area of the citation.

              Interesting.

                Call the court. Easy peasy.

Does your copy of the ticket has the court location date to appear?

The court could be backlogged, or the agencies records dept. A courtesy notice in the mail is not garaunteed, if you don’t hear anything, and the online system or clerk has no record, I would appear on your court date. There should be a date, time and location on your copy.

Don’t just assume it’s gone. Something similar happened to me and eight years later they randomly withheld my tax return. I had like $1500 in back fees and had a warrant out for failure to appear. Super bizzare because I never had it show up on a DMV record never received another letter or anything. No marks on a credit score, went through a couple of intense background investigations for LE. Nothing. Until one random day eight years later...

                        You can do two things.

First go to the court (or AAA) and using your copy of the ticket pay etc.

Or go to the court give them the ticket number but NOT the ticket and if they have no record. Request the form that shows you were there on time but the court had no record.

Courts give these forms out so you have proof you were in court on time. If the citation goes to warrant, FTA or collections (depending on the jurisdiction.) That form wipes the warrant, FTA or collections fees.

Do the first if you just want to close out the citation and do the second if you hope the officers ticket book was lost (Or he retired and threw it in the trash) and you want to try and avoid the citation on your record.

BTW, The Curtesy notice is just that. Never wait or depend on a notice from the court. Some jurisdictions send them and some don't and some send them sometimes.
