    Current state of DUI and Marijuana?

    So I'm just wondering how the patrol guys handle drivers who are observed by the officer smoking weed while driving or parked?

    The reason I ask is in my city there is a public area where almost always there are several cars parked and almost all the drivers are smoking... Then assumably drive away.

    What do officers do when they get a good description/plate on such a call?

      However, exactly what mg/deciliter THC concentration in the blood has CA defined/decided constitutes impairment?

          Also what priority is given to a report of a parked driver smoking in his car? As in where does it come in between jay-walking and murder?

            It depends on deployment levels, size of patrol force, and number of calls for service at any given time. In my city, it wouldn't be high on the totem pole. It is treated just like any other DUI investigation. We've been arresting ppl for DUI on weed for years and years before all this.

            It is illegal to drive impaired, no matter the substance.

              Ok thanks for the answers. As a tax payer I don't want to see this in my city (or anywhere for that matter) so I generally report it. From an officers point of view is it a worthwhile call to respond to?

                Depends on DA in your county as well.... some DA Offices won't file on marijuana DUI's without a pretty good (or bad, really) driving pattern.

                  I wish they would park patrol cars acroos the street from dispensaries like they do Bars. I see high drivers leaving dispensaries all the time near my work. Almost turned one into a hood ornament on the front of a 90 Ton Linkbelt crane the other day.

                    Impaired driving plus not completing the Standardized Field Sobriety Test as demonstrated= arrested for DUI. LAPD requires a certified Drug Recognition Expert to do the investigation. Non -DREs can make the observations and arrest, then call for a DRE to do the additional DRE Drug Influence Evaluation report.
                    Before I retired, I even testified as an expert on a couple of CHP arrests, after the fact. I was a DRE Instructor and Course Coordinator for a while.
                    Has to be a target-rich environment now. I see multiple impaired drivers daily here in the South Bay.

                      The CHP arrests were for DUI- cannabis. One of the harder evaluations for DUI.
