    Help understanding Citation

    I posted this in Off Topic but this forum is probably more appropriate.

    My daughter was cited for a violation of her provisional license. I'm looking for a little clarification to understand what the citation means.

    The officer was being nice. 45 in a 25 was there so if it went to court the judge would see that the officer only cited her for the license violation. Having passengers with a provisional license is the charge and what she will pay the fine on.

    Overall win for your daughter, her insurance costs.

      Agreed he was being nice, the 20 over would have been a much bigger fine. I think the section he cited is a very minor fine, and the court can impose the restrictions for another 6 months. Since she is so close to coming off the restrictions that probably won't happen, but traffic commissioner's can be tough to predict some times.

        In addition to the fine there may be some action from the DMV.

          DMV may choose to suspend or potentially revoke her provisional license depending on her driving history. She would then have to apply for her DL after she turns 18. I know it's happened to my buddy's son.

            This was her first offence. The good news is that it really got to her. She was in bed asleep early and wasn't her usual self tonight. In the end he did her a huge favor and I think he got his point across to her as well. I'll have to thank him. Win win.

              Yep, 20 over is a pretty stiff fine, plus in many courts they won’t let you go to traffic school at that threshold. I would often cite for 19 over with a warning for 20+ depending on how the speed was determined. If it was radar, it would depend on what speed I locked it at versus speeds indicated.

              Unless the person was being a fool, then they got whatever they had coming to them. Politeness and courtesy gets the same in return when there is room for discretion.

                Echoing others, sounds like the officer stopped your daughter for excessive speed and then only cited for the lesser finable offense of violating her provisional license.

                Pay the fine and take the medicine. Maybe a few extra chores around the house for a week or so to pay back the Bank of Dad.

                  That's very reasonable. I've been trying to figure out the correct consequence at home. The good news is that I think she learned her lesson. I usually point out issues with her driving but I don't think it was registering as much as it should have, especially when I'm not in the car with her.

                  I think that after this she realizes that she got off light this time, Dad wasn't kidding, and there are costly mistakes for your stupid decisions behind the wheel.

                    That was in OT?!?!?! My detail orientation failed.

                    You already have my comments, so good on the little gal for trying to learn from it. "Victimless" crimes are still crimes and can cost you more hardship than it was ever worth.
