    Travelling Questions

    Greetings,

    So, I'm out of Indiana and the girlfriend has family in California. She's planning on visiting and has been no further west than Denver. My thoughts are that it would be a great road trip - with one major caveat... I carry. I always carry. I obtained a carry permit two weeks after turning 21. I know CA doesn't have reciprocity with my state. I am aware that I would risk major legal headaches if I were to travel armed and be caught doing so.

    That being said... I'm more curious about the general and specific attitudes I would run across in-state.

    What would the average LEO in CA do in a situation like that?

    and

    What would you do in that situation?

    Assume a single .380 pistol with a backup mag.

    Friends of mine that have run across similar situations in Chicago either get told to get out as soon as possible or, in one memorable situation where I was present, had the frame of his handgun confiscated and mailed back to him. I laughed all the way back to the state line.

    All bad, lock it up before entering the state and try not to be murdered while in the PRK. Of course also make sure whatever you bring holds 10 rounds or less.

      Seriously,

      Keep it in a locked case, unloaded, no mag in the firearm. A LOADED mag in the case next to it is OK. The locked case in the car is fine as described. Keep it within reach.

        The glove compartment or console does NOT qualify as a locked container. The trunk does.

        This is the law enforcement forum. Please don't expect us to recommend that you carry illegally. No one can tell you what the average officer will do.

          I don't expect to receive a recommendation to carry illegally. Nor do I expect you to be able to tell me what the average officer would do. Most importantly, I don't expect to print this out and hand it to a LEO in CA and say "BUT THEY SAID!!!". But I won't deny that I'd pay good money to watch that scene play out...

          I asked what you would do. I also asked what you think the average LEO would do. Basically, I was interested in your perception of law enforcement in California from the perspective of a career in law enforcement. From the replies of others, describing the general attitude as 'hostile' seems to be fitting - which is not altogether surprising.

          Two follow up questions for those that can answer:

          Would a locked container underneath the drivers seat qualify for an unloaded pistol?

          Would the mags need to be stored in a locked container as well, or..?

          A Glock 42, Colt Pony 380, or Walther PPK would be the likely candidates, all under 10 rounds for the mag. I'd lean towards the Glock as the other two are pretty tough to replace these days...

            A first time offense of CCW, where the weapon is not registered to the defendant in California's AFS system, and where the defendant possesses ammunition for the weapon (even if the weapon is unloaded) is a felony (please refer to Penal Code section 25400(c)(6))

            The same is true for a charge of carrying a loaded weapon (please refer to Penal Code section 25850(c)(6)).

                    Well lets see, possibility of being arrested and spending some time in jail. Posting bail to get out of jail. Having your firearm taken and eventually destroyed.

                    Also, if you go back to Indiana and don't appear back here in court, an arrest warrant would be issued.

                    Having all this on your record, how would it affect your CCW permit in Indiana?
