Carrying retired LEOSA

Currently , my department has a list of handguns that I can carry on and off duty. What happens when I retire? Do I continue to follow Department off duty policy?

LEOSA does not require any specific weapon, and only states that you must quality with the type of weapon you choose to carry. Keep in mind that you will have to do an annual qualification to maintain LEOSA eligibility that meets your “department standards” for active duty personnel. So it seems that your department can have some impact on what you carry. Carry what they said or they will not let you qualify.

You can of course find another source for your annual qualification, which your old department has no control over. If you do that then you will only have to meet the LEOSA standards.

Followup to the "another source" option. That's usually reserved for situations where you move out of state or somewhere else far away enough that it's not practical for you to go back to your original department to qualify. In those circumstances you should be able to find a nearby agency that will qual you, and at that point the make/model handgun you use won't be as much of an issue.

- The agency INSISTS that you qualify through them and only them. Yes, LEOSA does permit other means of qualification BUT the agency holds a trump card in that it will not renew your retiree ID if you do not play their game so if you moved to NY you HAVE TO fly back on their designated day or your ID card expires and voids LEOSA carry rights.
- Some agencies severely limit the requalification days for retirees. 2 open days a year or you don't get requalified. A form of harassing retirees by an agency that does not agree with LEOSA. For folks from those types of agencies going to an alternate qualification course may be an option (unless you work for the agency in example one, above).

It never ceases to amaze me to what lengths agencies (that do not support LEOSA) will go to in order to make it as difficult as possible for its retirees to maintain their LEOSA certification.

Hopefully, the recent DC Court of Appeals case Duberry vs DC will begin to creep into its sister Circuits (including the 9th Circuit) and, used as persuasive authority, will allow individual retirees and/or law enforcement labor unions to seek relief in federal court in a Section 1983 action and LEOSA will then become virtual shall issue.

Back in October 2014, the Santa Clara County DSA sent out an email advising its members that Santa Clara County Sheriff Laurie Smith had decided to stop issuing LEOSA certification to retirees. Perhaps, with Duberry, the Santa Clara County DSA will take Sheriff Smith to task on her decision to stop issuing LEOSA certifications to retirees.
