    What do you Coppers do.....

When you run into someone who is carrying concealed with no permit. The person is just some normal Joe blow who wants to have protection if and when its needed But lives in a county where its harder than hell to get a permit.

    Always been curious about this.

I'm not a copper, just an average citizen.

I feel it would be very naive to expect an answer to that question on an open internet forum.

My advice is do not base your decision on whether or not to carry in violation of California law based on the replies of strangers on the internet. That being said, I will never arrest an otherwise law abiding person for exercising their Constitutional Rights.

I'm retired now so my comment doesn't mean anything!!

I would not personally accost any law abiding citizen for CCW w/o a permit, a +10rd mag or any other relatively minor offense like that. Just as I rarely cited people for a moving violation.

I carry regardless of what strangers on the internet say. I have a right to protect my Family and will. I will also use the same means to help you all out if the need where to arise.

You are all bad asses in a world of dumb asses.

          Thanks for the responses.

Some LEO's are letter of the law, some are spirit of the law. Personally I've ran into it several times with otherwise law abiding citizens that were very cooperative, often times more so than CCW holders. My advice is always go get your CCW as theres no excuse not to have one in my county since they have been shall issue for the last couple years. It's situation dependent... I would not advise partaking in illegal activity though...

Thirty years ago, if I encountered a person who was CCW, and there was no indication of criminal activity, and I was satisfied that the weapon was being responsibly carried, then I would "warn and advise" the person regarding the law and that was it.

There is a lot to be said for Penal Code section 4 and the principles behind it. The law should be used a tool to solve problems and should not be allowed to become of problem of itself. If no problem is being solved by an arrest, then there should be no arrest.

But it's also important to recognize the "organizational culture" of law enforcement agencies and for the manner in which they govern the amount of discretion accorded to their officers. The accepted level of discretion, for certain types of offenses, has been significantly reduced during the time I was in service. Domestic violence and weapons laws tend to be two areas where allowable discretion has been significantly "reigned in." During my time in active service my agency adopted a "mandatory arrest" policy for DV cases, and also started to view non-enforcement of weapons laws as being non-feasant.

Today, if the same above fact setting presented itself, I would see about half of the very tenured field deputies making the arrest along with most of the newer deputies.

All those mandated body cameras make situations like this less fun for LEO's.... Especially when staff gets to randomly watch the videos to decide if the LEO is "doing their job."

I attempt to do my job in a manner that I as a tax-paying and moral citizen would approve of. That's all I have to say.

I remember a couple of ofcrs who gave a guy a break by having him dump his marijuana down a storm drain rather than cite him and book it as evidence.

Each got five days suspended without pay after the guy complained.

Couldn't imagine what would happen with anti 2A police chiefs and letting a gun go.

IMO...The lack of allowing an officer too have discretionary decision making is just unfortunate collateral damage for a bunch of weak sister supervision jackasses who won't let their troops do their job. Did I say I really dislike weak supervision??!!

Carrying a concealed weapon is a misdemeanor and officers have a discretion on misdemeanors. What he actually would do depends on him and the attitude of the offender.
