    LE and Applying the Constitution

    To all LEO who care to respond: Why do you think it is that all these videos have been surfacing on YouTube in regards police encounters with the public in a not soo favorable light? It seems to me, as John Q Public, that the Constitution is not always be used or considered during these encounters by LE. Just help me understand, please.

    Sounding kinda vague, this may help. Let's say there's a person being detained by LE on the sidewalk, and someone, either a bystander or friend starts shooting video. The police tell that individual to stop recording, but LE know that in a public place, there is no expectation of privacy. This is just one of the many videos that keep popping up.

      It is not the job of the police to interpret the Constitution, it is to enforce the law's as written. When the law and the Constitution are in conflict it is the courts who decide, not Joe Blow with a video camera. The police have a duty to respond to calls, and the the soccer mom in the mini-van will call when she see's someone on a city street with a rifle, giving them exactly what they want a confrontation with the police so they can put it on YouTube.

        Good answer, that is understandable, but answer me this. Using the same video scenario on the sidewalk, if the person shooting video is not hindering the police while they conduct their business, doesnt the public in every state have the right to film a public official performing their duties in a public place?

                To answer your original question...there is obviously an personal agenda

                Because no one would be interested in seeing the ones that show officers in a favorable light...it is mostly boring
