    Question about off duty CCW

    My daughter's PD requires that their sworn LEOs apply for a City issued LTC permit and pay for the Live Scan to carry off duty.

    Is this normal for other PDs?

    That's really strange, my department sworn officers do not need ccw to carry off duty. They just need to carry department approval weapon and ammo as well.

      Sounds like they just want that $68.00 live scan fee.

        That agency needs to read the 830 sections of the Calfornia Penal Code.

          California Peace officers under penal code sections 830.1 and 830.2 (and some others) are full time peace officers, 24 hours a day, all year long. No requirement to obtain a CCW permit.

            The above posters have correctly pointed out the law.

            If your daughter's PD provides their officers with 830.1 or 830.2 peace officer status, there is no need for a CCW to be issued.

            Does she work for a special jurisdiction PD?

              I thought that it was weird, she works for a city PD.

                  What penal code sections define her as a peace officer? It should be stated on the back of her ID.

                    Is she a full time Police Officer?

                    Is the Department in question a California Police Department in an incorporated City. Either General Law or Charter?

                    If the answer to the above is yes, there is no need as indicated above. The California Penal provides the legal authority.

                      I have never heard of any California city/county/state agency requiring full-time peace officers to apply for CCW permits. I know of some agencies that require their correction officers to apply for CCW permits. State law requires a background investigation is conducted prior to hiring peace officers. The Live Scan would serve no purpose.

                      If there was a city requiring their sworn officers to apply for a CCW permit, I'm reasonably positive I would have heard about it through PORAC or on another forum.

                        My daughter works in the community correctional facility for a local PD but is a sworn LEO and can buy off roster firearms, high capacity magazines, etc.

                          I could be wrong, but your daughter could only have sworn status on duty. That might be the reason why they might making her get ccw through them.

                            Here is the thing..Is she 830.1 or 830.2 certified?
                            Did your daughter attend a full POST?

                            Something sounds hinky there..as if you say that she is a sworn LEO then she should be legal.. but if they are requiring her to get a CCW.. then it sounds like she is limited as to the Peace Officer authorities.. to while on the job..

                            Check and see withing the Penal Code exactly what section your daughter qualifies for.

                              This. Years ago I remember my father telling me that he was only on duty while he was officially at work (Federal officer) and could not carry off duty. Yet, now that he is retired, he qualifies under HR 218. I'm thinking that his position was reclassified sometime in the last 30 years or so.
