    LEOSA retirement requirements

    So I was talking with some buddies yesterday and an interesting topic came up re: LEOSA. For a retiree to qualify under LEOSA, they have to have a medical retirement or retire in good standing with at least ten years under their belt right? What about agencies that require more than ten years of service prior to them issuing a retiree a retired ID card with CCW endorsement? Are agencies allowed to have that kind of discretion in regards to LEOSA/retiree CCW?

    This isn't an issue that effects me; I was curious more than anything. I guess I will read back through the relevant statutes and see if I can figure it out but I thought I'd toss it out there to you guys as well.

    LEOSA does not require that a former LE officer be retired, it only requires 10 years of prior service. You do bring up an interesting point. If someone works for an agency for 10 years and quits, he is eligible under LEOSA. I suspect most agencies would not consider 10 of service an appropriate length of service to issue a credential, which is required under LEOSA to be able to carry a weapon. A medical retirements of course being the exception.

      LEOSA only creates an exemption from state laws governing the carrying of weapons by LEO's and Former LEO's who meet the qualifying criteria.

      There is no requirement in the LEOSA for agencies to issued the required ID cards, nor is there any requirement for them to offer the required range qualifications for their former LEO employees.

      That's probably not the best "though-out" way for the LEOSA to have been written, but it "is what it is".
