    Fixing Re-enlistment code

SO I served in the USN from Dec00-Dec04 and was discharged with a separation code MBK and a re-entry RE-4 code. Long story short my career counselor and I did not like each other. Heck I'll be honest, everyone hated him and he was the biggest kiss *** I have ever met. He put himself in for a NAM if that tells you anything. Anyway, by the end of my enlistment I didn't care about the Navy and I wanted out. I was over it, or so I thought.

I was an EM and the EM rate was over-manned and I remember him giving me 3 choices, either, 1) re-enlist in a different rate, 2) extend 18 months and try to re-enlist EM, or 3) get out. I chose option 3. He explained that by signing that paper I would never be able to reup in the EM field. I signed away without reading. At 22 years old, you just don't have that intelligence. Anyway, during my enlistment I made E-4, got my good conduct award, honorable discharge, did 4 yrs in the IRR and was subject to active duty recall.

I tried to go USNR and the paper work was going to get started because on paper I looked good until they noticed the RE-4. Given what I had on paper they were surprised to see that. My question is, how can they give someone an RE-4 and still give them an honorable and have them do IRR and be "subject to active duty recall" and have any of you had some similar experience with that? I want to appeal it because I want to join the reserves and it has been brought up in my last 2 LEO apps. Thanks a lot, and sorry for the long post.

Get in contact with the reserves and have them help you sort it out, anything can be sorted out you just gotta complain to the right person or complain long enough they fix it to get you away from them.

Usually an RE-4 code is giving with an Other Than Honorable or Dishonorable. You can NOT join the reverse with that code. Its gonna be hard to get it reversed. Good luck

How effective would that be? When I was at the USNR @ March ARB they saw it and stopped. I mean they were gathering paperwork to get it started and said they could do nothing for me.

You need to figure out why you got it in the first place.

You can make an appointment with your Congressman. Generally, they are not there but someone working at his office will help you.

As long as you have an RE-4, you cannot reenlist. RE-4 is non-waiverable. What you need to do is appeal your code. If everything is exactly as you told us, it should be easy.

DD 149 is the form to request the change.

RE-4*Prior service applicants issued a Reenlistment code of RE-4 (or equivalent) upon separation, solely for homosexual conduct may be eligible for re-enlistment/enlistment. (Note: Member's record must be reviewed to assure the sole supported reason for processing was for Homosexual Act(s), Conduct, or Marriage). The following applies:Eligibility Requirements.Applicant's prior service DD 214 (most recent) must reflect a narrative reason of Homosexual Act, Homosexual Conduct, or Homosexual Marriage in block 28.One of the following Separation Codes (SPD) must be in block 26: GRA, GRB, GRC, HRA, HRB, or HRC.Character of Service must be Honorable (no other misconduct was a basis for their discharge).Processing Procedures.Prior service applicants that meet the eligibility criteria listed in item one of this note may be accepted for further processing. All prior service applications accepted for enlistment/reenlistment with an RE-4 (or equivalent) due to homosexual conduct will be processed as any RE-code listed in the chart above labeled "Eligible to Enlist" with just an enlistment eligibility (rate and pay grade) determination (not an RE-Code waiver).

Yeah....that only applies if he was given RE-4 for being gay prior to the repeal of DODT and that it was specifically referenced as such.

I know about that clause, but I am not gay so I can't use that. Even if I could get away with it to change it, it is not an honorable thing to do.
