    CA Resident W2Buy firearm & bring back

    I have a question for anyone who knows the correct answer. My niece is stationed ConUS. She is a CA resident in another state and purchased a XDM 45 for a tour overseas. She asked me if she could bring it back home or if she has to sell it prior to returning. What are the details on this? What if she gets discharged prior to returning? How does she get home with a trusted friend?

    As long as no threaded barrel she should be fine provided she does not return with a high cap mag (put in in pieces).
    When she returns she simply sends in the form to register it and pay$19

    Keep in mind that as long as she has orders to another state as far as the ATF is concerned she is a resident of the noncalifornia state and can purchase guns in that state and can return with the pistol with no issues as long as it is legal here.
    Pursuant to Penal Code sections 17000 and 27560, any person who moves into California with a firearm is considered a "Personal Firearm Importer" and is required by California law to do one of the following within 60 days: Complete and submit a New Resident Report of Firearm Ownership (BOF 4010A), pdf along with $19.00 to the California Department of Justice, Bureau of Firearms; Sell or transfer the firearm to a California licensed firearms dealer or to another individual using a California licensed firearms dealer to conduct the transaction; or Sell or transfer the firearm to a California

      So long as its on the list, I don't think there would be a problem... The red flag that I see is her purchasing a pistol for a tour overseas. We're not allowed to take personally owned firearms on deployments. I know - I've tried. It'll be her issued Beretta M-9 if she's in any type of regular outfit... if she even gets issued a pistol. If she's going overseas as just a duty assignment, then the issues with taking a handgun to Europe or most asian countries would be more of a PITA than it would be worth to have something there to shoot... if there is a place to shoot.

      People talk about California like its tough on firearm owners - and as much as it is, compared to the rest of the world, its pretty damn open.

        +1. Agreed. I've only had an M9 or a Sig issued. Never seen the XD45 in service. That said jmsenk is correct.

          Can't use personal firearms for official duties, ie deployment. However if she legally purchased the XD as a military resident in another state CA has no issues with importing it back as long as she fills out a "new resident" registration when she comes back.

            It does not have to be on the list!! I have to laugh about comparing California to the rest of the world and not states within the USA.

            I repeat it cannot have a threaded barrel and the mags can't be over 10 rounds.

            The list is only what a dealer can sell you here, not what someone that moves, or moves back here can bring into the state. If you think I'm wrong look at the weapon on my avatar!!!

                Was it recently? I know during the beginning there was a lot of leeway in gear and possibly sidearms.
