    PCS to Cali.....need help

    ALCON,

    My fiancee who's starting active duty in the Air Force is PCSing to California. I'm currently in Iraq now and want to get things straight for protecting my Second Amendment rights when moving to California and was hoping some fellow service members or forum members could steer me in the right direction.

    First things first I want her to have some form of protection when she gets there so I told her to register two pistols immediately (HK P30 and HK Compact Tactical). The lady she spoke with at the DOJ informed her she had to register the pistols right away. She also said they must both have 10 round mags (which I had her purchase) leading me to believe I should be fine with the threaded barrel on the HK Compact Tactical.

    She said that as for assault weapons, they wouldn't be able to enter the state until we filled out the paperwork and they were approved. What are my chances of being approved for the following:

    FN SCAR, SLR AK-107PR and a Benelli M4 all with front grips.

    I ask because I'd like to know how this process works.

    Lastly, its my understanding the a Remington M700 wouldn't have to be registered as its not an assualt weapon.

    I'd appreciate any help I can get on this and I look forward to hitting the range with you guys when I get there. My weapons are yours to shoot so long as you don't burn to much ammo or bring your own.

    you cannot have a threaded barreled pistol in Ca.



    you maybe able to get a cap/thread protector? others will chime in.

      no threaded barrel

      must have 10rd mags unless you have some pre bans

      rifles need to have a fixed magazine or be featureless to enter( if semi not full auto)

      I think with the handguns you have 30 days to register them here from arrival. Also before moving remember we have a stupid list of approved handguns. So if you have been thinking about buying a gun now is the time to do it because you probably cant own it here unless you bring it with you.

        I had the same problem with my Eagle Arms AR-15. However, you can contact CA DOJ at:

        Most of the time they will not answer because they are so busy. Leave a message and they will eventually get back to you. The lady that helped me out was very patient and helpful. I told her that I am in the military and I will be on active duty status while in CA. Long story short, she sent a packet to my house with all necessary info to register my "assault weapon." If you are on Active Duty status and stationed in CA then you can apply for an assault weapons permit good for one year. The application costs about $75 to process. After the first year, CA DOJ will send you a simple form to sign to show that your information is correct and the renewal is free. If you send it in late then there is a penalty fee.

        YOU CAN ONLY HAVE AN ASSAULT WEAPONS PERMIT WHILE ON ACTIVE DUTY STATUS THAT REQUIRES YOU TO BE STATIONED IN CA (Such as a PCS, ADSW, or ADOS orders.) If you continue to reside in CA after your active duty orders ends then you are no longer permitted to have an assault weapons permit.

        For example, if your permit is good from 01Jan10 through 31Dec10 and your orders end on 01Nov10 then you cannot legally own the assault weapons permit for your M4 after your orders ends on 01Nov10; regardless of the fact that your assault weapons permit is good till 31Dec10.

        I had to send the following:

        Get my finger printed (Did it at a UPS store). The cost is dependent on where you go.
        A Copy of my PCS orders or any orders that shows that you are on an active duty status.
        I would call them to see what additional info you need.

        It is possible to get your permit for your M4 with your PCS orders through CA DOJ. I do not know if this is true for your FN SCAR or other "assault weapons." Call them and find out.

          The above posts all have good info, but I would add a couple of clarification points:

          Your original post isn't clear if you are serving on active duty. If so, you can apply for a permit as described in Phantom06's posting. I haven't heard of folks having problems getting these permits. Your fiance is also able to do the same for her assault weapons. This should also cover your HK "assault pistol."

          California law does provide the ability to obtain permits for assault weapons, but I've never heard of any ordinary person successfully obtaining one.

          A cap or thread protector isn't going to be adequate. The law defines the violation in terms of the "threaded" barrel.

          You'll have to register your handguns. That may be advantageous. If for some reason, you're arrested for carrying them loaded, or concealed, its a misdemeanor if they're registered to you. It's a felony if they're not (the law does allow a judge or DA to reduce to a misdemeanor, but I would not count on that in certain counties).

          California allows possession of the hi-capacity magazines, but it's felony to bring them into the state, to manufacture one within the state, or for anyone to sell them to you within the state.

            The weapons belong to my fiance of course. I've already considered buying a regular non-threaded barrel for the HK Tactical just in case. In either case I'll put it on the Assault Weapons Permit just to be safe and hopefully they'll allow it with the threaded barrel as an assault weapon. I will definitely register the weapons. I'm not at all attempting to break the law or claim I "didn't know" after the fact. I'm just trying to figure the very confusing laws out so I can ensure I abide by them. She is on active duty and has PCS orders, I am currently in Iraq but will be stationed at Bragg/Benning when I get home but will be staying in CA a lot.

            Apparently finding 10 round .40 mags for the P30 is tough but I believe I can buy P2000 mags and change out the base plates and they'll work. I'm having her check this out this week. If anyone knows for sure I'd really appreciate the intel.

            It's getting close though and I want to make sure things don't get down to the wire. If all else fails I'll have her take the P30 (with 10 round mag) and move the guns after the fact once they've been register with the Assault Weapons Permit.

              Im pretty sure you can get a military waiver (register it as a an AW) if you wanted to keep the barrel on the pistol.

                Yeah, of course I want to keep the barrel if possible. Tactical hardware is all I buy. I will definitely try to register it as an AW and hopefully it won't cause much of a "stir" at any ranges I go to.
