I think the embody case was much better than the drake case. I wonder when the court will take a petition up now that they denied drake. I wonder what they were waiting for?

They are waiting for:

1. An open carry case with no "baggage" attached.

In other words, there's no felony homicide, assault, or whatever attached to it. Just someone who is charged with carrying openly in a state that bans it AND enforces may issue CCW.



2. A simple straight forward question that needs to be answered for a state that flat out bans it AND only allows "may issue" CCW.

Think the Embody question...



3. A litigant that can keep up with the court business, proceedings. filings and not piss off the judge by crapping in their political arena.

In other words, doesn't hurt to have an attorney who is familiar with how things are done and doesn't try to be a politician in the courtroom.
