NRA v Cuomo (Filed 4/2/20) - Gun Stores Shut Down as Non-Essential (Dismissed 8/14)

Don't see this posted yet. Moderators can move if it is.

    NRA v Cuomo filed 4/2/20

No. 202.8: Continuing Temporary Suspension and Modification of Laws Relating to the Disaster Emergency

Of course, the anti-civil rights people are already condemning the suit...

From CNN - NRA suing New York for deeming gun stores non-essential businesses during coronavirus pandemic

...Kris Brown, the president of the pro-gun-control group Brady, called the lawsuit "another attempt by the NRA to jeopardize life-saving responses to stop the spread of this deadly virus that is killing thousands of New Yorkers."

She said Cuomo is "well within his authority" to close the stores in an effort to address the virus's spread.

"The Second Amendment, like all amendments in the Bill of Rights, is balanced by concerns of public safety and health," she added. "Right now, those concerns necessitate the closure of many businesses, including the need to forbid large gatherings, which are rights otherwise protected by the First Amendment. The Second Amendment does not supersede the First, nor does it override the need to stop the spread of coronavirus."
From Bloomberg - NRA Sues New York State Governor Over Closure of Gun Stores

Cuomo has publicly reacted. As reported by Business Insider... The NRA is suing Gov. Cuomo after New York closed gun shops as non-essential businesses

..."I think I've been sued by the NRA, must be a dozen times," Cuomo said at a press conference Saturday. "I didn't even know I was sued this time. You become sort of lawsuit-immune. I wish you could become immune to this virus the way I've become immune to NRA lawsuits."...

Of course the Anti 2A diskwad politicos are IMMUNE. Being sued is a political feather in their dickhats. Plays to their base as activists. And never cost them personally even one thin dime. Because of IMMUNITIES built into the self perpetuating political crap mill.

Even blatant unconstitutional losses in court. Still drive fund raising and constituent votes.

If it's the Governor, I don't believe a lawsuit will prevail.. If it's a local sherriff as in LA County it could..
At least Trump and all "real" American states know that gunstores are essential...Liquor stores as well.. Blade Ops and Blade HQ here still open.

U.S. judge dismisses NRA lawsuit challenging gun shop closures in New York state

A federal judge on Friday dismissed the National Rifle Association's lawsuit challenging New York's decision to close gun stores in the state in the early stages of the coronavirus pandemic...

U.S. District Judge Mae D'Agostino said the NRA lacked standing to challenge on behalf of its members a March 20 executive order by Governor Andrew Cuomo requiring gun stores to close in the state because they were "non-essential" businesses.

D'Agostino, who sits in the state capital, Albany, also refused to let the NRA amend its complaint, saying it would be futile because there was no evidence its ability to conduct day-to-day advocacy for its members had been impaired...
Court backs Cuomo shutdown of gun dealers during pandemic

Much of Friday’s decision from Judge Mae A. D'Agostino of the U.S. District Court for Northern New York was based on technical grounds, rather than the broad constitutional arguments posed by the NRA.

The judge found the NRA, as an advocacy organization, failed to show how it was hurt by the executive order. The judge noted the NRA had, on its own, canceled some of its instructional courses during the height of the pandemic.

On June 23, 2010, Senator Chuck Schumer recommended D'Agostino to fill a vacancy on the United States District Court for the Northern District of New York.

On September 29, 2010, President Barack Obama formally nominated her to the Northern District of New York

technical grounds, rather than the broad constitutional arguments posed by the NRA.

It would appear the NRA had appealed this case to the 2nd Circuit... NRA loses federal appeal over New York gun store closures

...In a 3-0 vote, the 2nd U.S. Circuit Court of Appeals in Manhattan said the NRA's bid for an injunction was moot because there was "no reasonable prospect" of more closures, after the state legislature curtailed the governor's power to impose COVID-19 restrictions.

The appeals court also refused to award nominal damages, saying the NRA lacked standing to sue on its members' behalf, and that sovereign immunity under the U.S. Constitution's 11th Amendment barred claims against state officials.

Lawyers for the NRA did not immediately respond to requests for comment. The office of New York Attorney General Letitia James, which represented the state, did not immediately respond to a similar request...
