    I find it... interesting?... predictable?... that 81,000 people the State thinks owns handguns haven't "responded to the State's request."

    Everybody I know in Manhattan has at least one gun. NY believes them to be gun free.

        It would appear as though New Yorkers have called the state's bluff. Intentionally or not is a different question.



        State and county law enforcement say they do not plan to pursue criminal charges against pistol permit holders who fail to recertify their permits by Jan. 31.

        In recent months, state and county officials have raised concern that failing to extend the recertification deadline would turn thousands of law-biding pistol-owners into criminals overnight.

        The recertification requirement was passed in 2013 as part of the New York Secure Ammunition and Firearms Enforcement Act, which mandates that permit holders re-certify every five years. Only those who acquired their permits before Jan. 15, 2013, are subject to the Jan. 31 deadline.

        According to state law, those who fail to re-certify could lose their permits and potentially face an illegal-weapon possession charge, should they be caught after Jan. 31.

        But both New York State Police and the Niagara County Sheriff Jim Voutour say they will not bring criminal charges against those otherwise law-biding citizens.

        “These people with pistol permits, they're law-biding people," Voutour said. "This is new to them, particularly the people who've had permits for many, many years.”

          What I find more disturbing is that about 300K New Yorkers DID register with the State. I really thought there would be a higher rate of civil disobedience.

            Different news stories are giving different numbers, and nobody really knows for sure at this point. A lot of re-certifications were sent in by mail, so all of those most likely won't be processed for a while.

            That news story is also listing a 370,000 number for the total number of permit holders that needed to re-certify. Estimates for the total number of permit holders in the state are somewhere between 1.2 and 1.5 million. So this article puts the compliance rate at around 25% instead of the 20% non-compliance rate that the NPR article lists.

            The New York State Police say troopers will not crack down on pistol owners who "unknowingly" miss the deadline. They just want pistol owners to register.


            Time will tell what the actual numbers end up being. The state refused to cough up the numbers for "assault weapon" registration until someone filed a lawsuit and a judge ordered them to do so. We'll see if they are as forthcoming about the pistol permit numbers.

              The issue is a little different from the AW ban. It is easy to modify your weapon to remain legal and the govt has no clue what long guns you own since they could be bought and sold face to face until 2013. Not registering is low risk.

              However, with regards to handguns, the stakes are much higher. In NY, it is illegal to even touch a handgun without a permit, doing so is felony.

              Handguns in NY are illegal to possess UNLESS you have a permit.

              Every handgun you own must be on a premise or carry permit which lists the make, model, caliber and serial number. Your permit gets updated by the county clerk whenever a handgun is bought or sold. All but a few counties issued permits that were good for life.

              The safe act is placing an expiration date on lifetime pistol permits; forcing people to renew every five years. Possessing a handgun with an expired permit is a felony. Possessing a handgun which is not listed on your permit is a felony.

              If you have been playing by the rules, the issuing county already knows what handguns you have and if you have renewed. It is a simple matter for the state to look at who hasn't renewed; check if they have passed away. If they are alive and well, send a letter or pay them a visit. At that point, the hold-outs have been had. Mr. and Mrs. America, give up your guns (or go to prison).

              It's really a shame that the 2nd circuit rubber stamped the law and the SC refused to hear the case. It is clear that the entire pistol permit licensing scheme is illegal given we have a RIGHT to KEEP and bear arms.
