    LAPD confiscated weapons... DOJ approved return... LAPD refusing to return Ammo.

    So CalGuns, I need your advice. Please let me know if this is in the wrong forum.

    My uncle had a minor domestic incident at his house. Neighbors called police and LAPD showed up.

    Him and his wife were yelling at each other pretty badly (no violence), no one was charged with anything, nor was anyone arrested. LAPD did help themselves to his safes collecting a total of 13 firearms (6 handguns 7 Long guns), several thousand rounds of various ammunition (90% of which was High quality self defense rounds/ HP), a few accessories, and a bullet proof vest.

    Took several months but after filling our the LEGR the DOJ finally approved the release of the firearms but now we have a new problem and I would love to get y'all's advice before having to hire another lawyer.

    LAPD detective has approved the release of his firearms but is refusing to release any of his ammunition or accessories (speed-loaders, lasers/lights, and a bullet proof vest) that they took on the same day.

    Considering California is still having an ammunition shortage and they took roughly 3,000 rounds of various ammunition (mostly self defense hollow point rounds) and another 2,000 of match grade 22LR... Most of it was purchased 8+ years ago and cost about 2000.00 USD then. It's an expensive lot to try and remake it at today's prices.

    Side note: The vest is Type IIIA but is about 7 years old so I am not even sure the vest is still good, any one know if its still good?

    If anyone has any advice at all, I would love to hear it.

        Yep.....looks like the department has their greedy, beady eyes on that ammo and gear.

        Make their life a bit harder. Go after them.

          Wow what a vague story.

          What reason did they give your uncle for not returning his ammo?

          Does he have proof they took his ammo?

          Why would they confiscate ammunition? I thought they could only take guns?

          The only advice anyone can give is get a good attorney. CalGuns has some attorney's that specialize in firearms-related cases.

            I dont have a good answer for you but wondering ..... what is the LAPDs reasoning for not returning the ammo and accessories. Did they give a reason?

                The attorney will easily cost more than the ammo. They f'd you and theres no winning. Either wait it out or decide how much being right is worth to you in dollars and time.

                Not saying its right or ok... But once lawyers get involved its just ugly and a financial burden.

                  I used to only sieze weapons per law. They should have given a reciept for the weapons and other items?? What does the reciept show?? If he can prove that other items were siezed ,contact an attorney. All those alleging theft, should not give their opinion of what they would do. Not every one thinks like you!!

                      What is your explanation then for them failing to return private property? There is no lawful reason for him to be deprived of his property. They are either keeping it for their own use, or intentionally depriving him of it under color of law because they don't agree with the second amendment.

                      Like everyone else said, attorney.

                          File a claim against the City and get a lawyer when it's denied.

                            What is wrong with filing in small claims court? You will not need an attorney, can represent yourself, and hopefully get the court to see a justified position of returning the ammo or refunding you the appropriate value. You don't need an attorney for everything.
