Denied C&R Registration BOF 961

Well this is interesting.

I bought a Swedish Mauser {1907} from a fellow in PA. on G/B .
I sent him the $ ,my 03 and COE and he shipped me the rifle.
So far so good.

I filled in the BOF 961 form ,included a check for $19.00 and also
sent a copy of my current 03 and COE.

I was denied on the basis that all transfers must go thru an 01 dealer.

The DOJ references the "Firearm Ownership Record"in the denial'
which when looked up is form FD4542a. {I did not submit that form}

Reading page 2 instructions {top} I did everything correctly.

Did something change ?

Legal advise requested.

Nope you have done nothing wrong. You are the second person to receive this. Another reported it in the C&R section. Contact CAL-GUNS.. looks like the DOJ is doing illegal things ... again.

It sounds like you need to point the DOJ to State Penal Code 27966.

Commencing January 1, 2014, if all of the following requirements are satisfied, Section 27545 shall not apply to the sale, loan, or transfer of a firearm:
(a) The sale, loan, or transfer is infrequent, as defined in Section 16730.
(b) The firearm is not a handgun.
(c) The firearm is a curio or relic, as defined in Section 478.11 of Title 27 of the Code of Federal Regulations, or its successor.
(d) The person receiving the firearm has a current certificate of eligibility issued pursuant to Section 26710.
(e) The person receiving the firearm is licensed as a collector pursuant to Chapter 44 of Title 18 of the United States Code and the regulations issued thereto.
(f) Within 30 days of taking possession of the firearm, the person to whom it is transferred shall forward by prepaid mail, or deliver in person to the Department of Justice, a report that includes information concerning the individual taking possession of the firearm, how title was obtained and from whom, and a description of the firearm in question. The report forms that individuals complete pursuant to this section shall be provided to them by the department.

It was me this happened to. I wonder if they thought my 1903 Springfield was a modern one, not a 1918.
I wrote a letter of explanation, took a photo of the area showing the serial number and manufacturer and sent it back.
I could not read the signature that processed it.

Isn't the form BOF 4100A? BTW, the instructions don't say to send them a copy of C&R and COE, just the filled out and signed form and the check.

No. That form is used for C&R acquisitions that occur outside of California.

Miss Danica got a hold of DOJ on 8/12 and my registration arrived today.[8/15]
As it was ink signed by the Director,maybe she will get her staff better trained.
