    unlicensed concealed carry

    carrying a concealed firearm inside your home is legal. but:

    1. what if your going from you are going from your car that is in the parking lot to your house & visa versa. of course securing it in the car while traveling.

    2. what if your going from your apt to a friends apt in the same complex. since both destinations / areas your allowed to have the firearm.

    3. working in a small building 200sq. ft. that is not open to the public just me & one other employee. that is always locked. since its not public is ULCCW Ok.


    all of these questions in having trouble finding online.

        With very few exceptions (which usually involve you being out in the middle of nowhere), you cannot carry concealed or open, either loaded or unloaded in public without a license unless the pistol is unloaded in a locked container. That means you cannot carry in your front yard or driveway (if un-fenced), you can't carry on the way to the parking lot, you can't carry in a public apartment complex if you are going from your apartment to a friends etc. In any of those circumstances, a pistol must be unloaded in a locked container. People have been convicted of concealed carry while standing in their own driveway of their own home. You will be convicted if caught carrying outside your own personal apartment. If your friend allows you to carry in his home/apartment, you can unlock from the container and load your pistol when you get there and then carry it open or concealed in his apartment.

        You also cannot just wander around on foot in public with a pistol in a locked container. If you are not in a vehicle, you have to be going between places where you are authorized to have it, with only reasonably necessary deviations allowed.

        You can carry loaded & concealed at work if you are in an area that is not accessible by the public, and you have permission from the business owner.

          There are certain exigent circumstances that allow unlicensed concealed carry such as imminent grave danger or if you become targeted by a violent person whom you've issued a restraining order against, but IANAL and it's probably best not to test the edges of the law unless the circumstances warrant.

          P.S I realize your post deals with where can one carry, not when. I figured I'd throw this out there since if it were to apply then 'where' becomes moot.

            I think you are wrong here about a locked container. You do not need a specific destination with only minor deviations.

            Transporting is transporting.

              I wander around on foot in public with an unloaded pistol in a locked container ... at the airport ... a lot! ... Most usually ... looking for the !!!@#@@!! check in terminal.

              I have not been arrested for doing this .... yet?

              Can one get arrested for this? This is the 1st I have heard of this. Even the security dudes, at the airport tell me they check in their firearms before boarding the airplane. Much the same as I do.

                  I carried concealed for 12 years in my Peterbilt Truck without a permit. Then while in Nevada I was in an accident.

                  While waiting for the tow truck the NHP Officer asked, "is there anything in the truck I need to get out before the tow truck takes it away?" i told him "I have a Ruger SP101 357". He said, "You better go get it". Upon returning to the NHP Cruiser he asked, "you have a CCW", "I told him no I don't", he said, "okay you can cite the 2nd amendment this time, but you should get one, some officers might not see it the way I do"....So I got my CCW.

                    Presuming you do not get lost and wander into a sterile area, no issue with CA law. You are transporting locked unloaded, presumably from your vehicle, to a place where you are allowed to have it, the airline check-in counter.

                    What you should NOT do is get to the airport with your unloaded encased gun, stop for lunch, do some shopping, go up to the observation deck and THEN go check in your gun - just as you should not park in the lot of your local indoor gun range, take your unloaded encased gun, go to lunch, do some window shopping, take a turn around the park for exercise, and THEN go to the range to shoot.

                      Ive read most of the posts. I go to friends houses, parents, my apt, maybe a minor deviation but rarely. Its in a container. Its just when im at my destination seems better to take it out in the car and put the firearms in my pocket. Then go inside the residents.

                        Well this is a minor setback until march when i get my carry permit just trying to make sure i read the laws correctly so no unwanted attention aka ending up in county lockup. Thanks everyone in the forum.

                        I limit my deviations to 2 or less when armed. Mostly being having a gun in the car i dont need my car gone and my weapon if someone wants to steal my car.

                          The truck driver carrying a gun, i think the cop gave you a pass because truck drivers need a gun because thats technically your temporary residents. Kinda like a hotel is. Plus truck driving is dangerous business. Getting robbed or killed is a big problem when on the road.

                            Carrying a loaded pistol in your car/truck/big rig is legal in Nevada - there is no law against it. You can have it on the seat next to you, or on your person is if it clearly visible. It is also legal to conceal a loaded pistol in your vehicle in Nevada without a permit. You just cannot conceal it on your person unless you have a CCW. Out of the car on foot, open carry (clearly visible) of a loaded pistol is legal in Nevada without a permit.

                              Couldnt quite figure out the statement but, if the garage is attached to your house and you dont have to venture into any space that the "public has access" than you can CCW. The moment you step out into any space that the public has access too, you can no longer CCW. Remember, no unlicensed CCW allowed in any place where the "general public has access". Garage attached to house, OK (you are exempt from concealed carry laws since your garage attached to your house is your private property). Garage non attached and you have to walk into a "public accessible" area, not ok. (after reading #2, the area you must travel to from your apt to your car is public accessible, no unlicensed CCW allowed.)

                              2. what if your going from your apt to a friends apt in the same complex. since both destinations / areas your allowed to have the firearm.

                              there is no exemption for you to CCW at your friends. It is not considered your "temporary place of residence". Place of residence, either temporary or permanent is like your home, apartment, hotel, camp ground... not "other people's home that you visit" (the temporary place of residence grants you exemption from both conceal carry laws and loaded firearm laws. The area connecting your apartment to your friend's apartment is considered "public accessible" and therefor you need licensed CCW.

                              For your "legit" place of business/work, if you are the owner, you may CCW without license. If you are not the owner and just an employee, you may open carry loaded only with owner's permission. (both circumstances fall under the exemption for carrying at your place of business.
