246.3. (a) Except as otherwise authorized by law, any person who
willfully discharges a firearm in a grossly negligent manner which
could result in injury or death to a person is guilty of a public
offense and shall be punished by imprisonment in a county jail not
exceeding one year, or by imprisonment pursuant to subdivision (h) of
Section 1170.
There is no "safely" discharged into the grass.
Does the person shooting the gun know for a fact that there are no rocks, metal pipes, gas lines, or any other objects just under the grass? I think not.
A ricochet could very easily kill the shooter himself or even a bystander. "A person" as noted in the PC also includes the shooter.
Definitely negligent.
