I'm sorry to hear about your half sister.
I know that inheritance can happen between parents and children, but I don't know about it happening between siblings or half siblings. I'd imagine that if your half sister had any kids, they would have first right to it before you.

You should definitely research the laws, and then confirm them with the FFL you are planning to do the register. The California Department of Justice does have phone numbers you can call and you'll get through if you're persistent. They'll answer the questions you have, as long as you speak to a knowledgeable person. I had an issue getting a pistol out of an evidence room at a police department (LAPD), so I know the process for that.

Long story short my Sister passed last May 2013. In cleaning out her apartment I found a long gun.
Question: should I do the self register, not knowing its background. I have the Death Certificate and obit, but we have different last names (half sister)
She died intestate , no will, no kids

Transfer occurred before 01-01-2014, which means that you are not required to notify CA DOJ since the firearm is a long gun.



If you wanted to, you could voluntarily register it by submitting a Firearm Ownership Report to CA DOJ.

Of course they did; income protects their job. It's like asking a building inspector, "would I need a permit if......".

You should wait on sending the form until you get better clarification from a more knowledgeable source than me, but..... I believe that if the inheritance was before 1/1/2014, sister to brother, you do not need to submit transfer documentation.

To the OP, there are a couple of things you need to understand. First, long guns have not been registered in this state until 1/1/14. The state has no idea who owns what long gun by serial number unless it was purchased after 1/31/13.

IIRC, in CA FTF sales without going through a FFL were still legal up until 1991, so there are still a lot of long guns and hand guns that have never been transferred through the DROS process. Then add the number that came into the state when people moved here before they were required to register them.

Now consider that when you spoke to the person at the DOJ, they were telling you what to do based on the current law. Since 1/1/14, when one acquires a long gun, it has to be registered with the state. That is why many of us parents purchased long guns to gift to our children last year, it was the last year we could do so without having to register the transaction with the state. Also, IIRC, the state does not allow long guns to be registered to those under 18.

The person you spoke to very likely assumed you inherited the rifle this year and therefore you legally are required to register it. Since your sister passed away in 2013 and you inherited then, you are not legally required to register it. You may voluntarily register it, but you are not required to.

Of course the DOJ wants your money and wants you to register it. They are a government agency and they exist for that purpose, to collect money and information.

If you are worried about problems down the road, then keep the death certificate. That will demonstrate when you inherited the firearm. That is the proof you need you inherited it before registration was mandatory. Put a copy of the death certificate in the rifle case if it makes you feel better.

Ultimately, if ever questioned about it by LE, your safest course of action is to say I will not answer any questions until I speak to my attorney and then STFU no matter they say. Let the attorney do the talking.

You are worrying about something that has a low probability of happening, unless you know something about your sister that makes you suspect that she has come by this rifle in an illegal manor. If that is the case, then your best bet is to contact an attorney and let the attorney do the inquiry about the possibility of the rifle being stolen property. An attorney can do that and if it comes back as stolen he or she can then hand it over to LE without implicating you at all.
