    Interstate Handgun Gift FFL Confusion

    My Step-Father who lives in Michigan wants to gift me a Ruger Single Six that is currently registered in his name in Michigan. He will be flying out this weekend for a family function and will be bringing the gun with him.

    I am looking for clarification on how to proceed with the transfer. From what I have read from the wiki is that because it is interstate the Feds say it must go through a California FFL. And though he will be here it is not a PPT because of the interstate issue. So the gun has to be DROSed at the FFL I will have to go through the 10-day waiting period and there is no limit to what the FFL charges me. Correct?

    The reason I am asking is because I have contacted most of the FFL's in the East Bay and I was told by all of them to use the OPLAW form.

    Before I start calling some of them back I would like to make sure that I am interrupting the law correctly.

    Also if someone knows a FFL East Bay mainly Tri-Valley that can do it, im all ears.

    You are correct, you cannot OPLAW an interstate transfer.

    I'm not even sure if you qualify for intrafamlial exemptions because he's your stepfather.

    Yes, the FFL can charge whatever they want for the transfer.

    You will need an FFL willing to receive a handgun from a private party.

    You will need an FFL willing to use the intrafamilial transfer exemption (if the handgun is not on the roster) If it is on the roster, the exemption doesn't matter.

      Your correct. Luckily the single six is exempt from the roster, so no issues there. However they can charge you as much as they see fit, even if it was intrafamilial they still can do that. I don't see an issue with him walking into a shop with you to do the transfer, and yeah 10 day wait.
      As far as a shop that will do it, I'd try Tracy Rifle and Pistol, give them a call they should be able to help you out, good folks there.

        It may not matter for the Ruger Single Six, but unless you were formally adopted, the law appears to exclude 'step-parent' from the people who are defined as 'family'.
