Hi All

I have inherited an Assault rifle from my Grand parents.

I have no need for it, How would I sell it since it is not in my name.

The rifle is a Bushmaster HBAR A2 style with a 1/9 twist.

Assault rifles are illegal to sell in ca, if that lower is on the list you may want to contact an attorney.

Regardless if it was registered in one of their names or not, there is little you can do. If it is in the list, you can find an FFL who has an assault weapon license and sell to them. Or you can disassemble it and sell the barebones to the same FFL. Or turn it in to your local law enforcement agency. Or sell it out of the state. Talk to a licensed AW FFL. Others who know more chime in and correct me if I am wrong.

its not illegal for him if it was inherited, however he has a limited amount of time to sell or take out of state if it is an actual assault weapon

Any person who obtains title to an assault weapon registered
under this article or that was possessed pursuant to subdivision
(a) of Section 30630 by bequest or intestate succession shall,
within 90 days, do one or more of the following:
(a) Render the weapon permanently inoperable.
(b) Sell the weapon to a licensed gun dealer.
(c) Obtain a permit from the Department of Justice in the same
manner as specified in Article 3 (commencing with Section 32650)
of Chapter 6.
(d) Remove the weapon from this state.

1. Sell it out of state
2. Sell to a FFL that is able to deal in AW
3. Strip off all of the parts and dispose of the lower buy either selling it, cutting it in half, or turning into the police.

I would either sell the whole deal out of state or transfer the parts to a CA legal lower and sell the lower reciever out of state..

Hi The Bushmaster looks just like the ones for sale at any gun shop, I guess I am not sure if it is an Assault Weapon. I think it is just a run of the mill AR-15
It was purchased around 1996 / 1997. No flash hider, no bayonet lug.
Pretty plain.

If it is "run of the mill" it probably has no BB. If it can drop a mag without a tool, and has any "evil features" then you are out of luck. It will need to be re-configured (add bullet button or go featureless) or disposed of as above. If it was registered as an AW (it's older than you think it is), then it must be disposed of.

BTW, your "run of the mill" AR-15 (A2 HBAR) DOES have a flash hider and (likely) a bayonet lug. The "birdcage" A2 flash hider is an evil feature.

If you aren't up to figuring out all the legalities, sell it off.

Since you're not quite sure what you have (re: 'assault weapon'), you might want an opinion by someone more familiar with them, but sunborder has posted the likely situation.

California does not check guns for sale to see if they are owned by the seller; until 2014 it was not even possible for most long guns - no records were kept by the state. (They DO check to see if they might have been reported stolen, but that's not an issue here.)

The only AR I registered under the old "assault" weapon ban was, as you put it, a "run of the mill" Bushmaster.

Purchased ftf in Texas in 1994, it was what used to be called a "post-ban" gun.

No muzzle device, no bayonet lug. Other than that, everything else was A2-HBAR. It came from the factory that way.
