DROS a stripped lower as a pistol when moving?

Since I'm planning to move into the state soon, I'm considering bringing a spare stripped lower or two. Should I DROS them as pistols? If I do so, can I later transfer them with a PPT and/or build AR pistols on them?

Are there any disadvantages to DROSing them as pistols? Would I still be able to build a long gun on them later?

    Thanks,
    Eric

You won't be "DROS"ing them. There will be no Dealer Record Of Sale. You will be declaring that you imported them and registering them. That said, might as well do them as pistols. I don't see any disadvantages.

      Are they currently registered?

Will it make a difference if they were already registered as long guns?

They are not currently registered as anything. I've been told that if you register a lower as a long gun, it's unwise (possibly illegal, with no test case yet) to build an AR pistol on them.

When you bring them into the state, declare as a pistol.

No one knows what the legality would be. So, register them as pistols just to be safe. Then, if you decide to change your mind, you can always make them into rifles without a problem.

Curious. If you DROS it as a pistol and then convert to rifle what happens if you put a forward pistol grip on it? Or some other no no for pistols that are ok for OLL/BB rifles?

If they get registered as pistols then built as rifles they will become short barrel rifles in CA DOJ's eyes.

You have it backwards. It can't be a SBR if it has a barrel over 16" and an OAL of over 26". An OAL of 26-30" would make it an AW though.

I'm pretty sure that if you put a stock on a pistol it is still a pistol in DOJ's eye regardless of barrel length. Hence SBR.

When converting to rifle must have 16" barrel at that point in time. Must pass the 30" min length also.

26" unless it is a centerfire semi auto with a detachable magazine. Then, it would be 30".

                        JDay,

There is a legal definition of a SBR and it has to do with barrel length and OAL. However, it has ZERO to do with it being "registered" as a "handgun".
