    Off-roster transfer between husband and wife

    Wife owns an LC9-LM. I want to put it in my name for CCW, but it is now off-roster. Can we transfer it?

      Just to be safe, since the form is required within 30 days, and it's been sitting in the safe on my side of the bed, I could say I took possession 20 days ago, before it dropped off, right?

        The OPLAW form is supposed to be submitted, by the receiving party, after the transfer takes place. You and your wife know when that was or will be.

          Just out it in your license. Heck, put it on both your licences. The law doesn't require the firearm be registered in your name.

                Actually it could be if the model make and gun were purchased/transfered after mandatory handgun registration.

                Additionally, most people here trying to get their CCW's in todays world, would rather just get their permits and not make things last longer than they need to by challenging every single rule that might or might not be legal. That job is better left to CGF or the NRA at this point.

                  Don't forget OPLAW requires the serial number from your current HSC.

                    Can you show the PC that limits guns on your license to only those owned by you, and excludes those legally possessed?

                      You are missing the point. When you apply and submit serial numbers for the weapon you choose they run those numbers. If a 25 year old were to say list a newer Glock and the numbers were run, and the last registered owner came back as John Q Public who lived in CA his whole life, and the applicant has no association with John Q Public. Explain to me how the 25 year old obtained that hand gun legally as a CA resident?

                      It could imply that the hand gun was not legally obtained which would show "not so good Moral Character"

                      They do run the guns through DOJ/BOF when you get a CCW.

                        Dan, keep in mind too that when a person from another state moves here they must register their firearms with DOJ also. Did they follow the law? DOJ and FBI background checks along with firearms checks tends to show things.

                        I understand your point but TODAY anything is worth taking into account.

                          This is not an issue of the gun being registered to John Q. Public with whom the license holder has no affiliation. The weapon in question is registered to his spouse.

                          If the numbers are run and come back to another person a quick question to the applicant can resolve any questions, and should.
