    Transferring a pistol to my 19yr old daughter (it was quick, but not painless)

    I recently gave my daughter her first pistol, a Ruger LCRx 3" .38SPC. She had to go get her FSC first and after studying for a few days she went to the LGS to take the test. After they asked her some questions about why she wanted FSC they waved her off when she said her dad was giving her a pistol, and said it could not be done so they did not administer the FSC test.

    I called them and explained it was legal but they said even their DOJ rep thought it was not legal (no surprise). I assured them it was legal and they said come back and she can take the test. So in spite of the false start they were really good about it.

    She passed the test only missing one question, then we went home and she signed into CFARS and filed the oplaw/intrafamily form. About three weeks later she got a letter in the mail confirming the gun had been transferred to her (record time!).

    So yes it is still legal to give an 18-20 yr old a pistol using intrafamily transfer, they just need a FSC (which might be the hardest part).

      Kind of strange they would ask why she wanted it. Seriously is it any of their business? Maybe it's just me, but when I was giving the tests, I just assumed that the person taking the test was going to get a gun. I can't think of another reason to spend $25 on a piece of paper that's only good for one thing.

        No, it’s not any of their business, but being that they own it, their option to be rude is fair game. And to that end, I’d find a different FFL. Old fudders like that only serve to drive off business, and bolster the poor reputation that all to many FFL’s have earned.

          Believe me I brought it up: 18yr olds can take the test, and their job at the store is simply to administer it, not play lawyer.

          The gist of their answer (I think) was they didn't want her wasting time or money on something she could not do, nor getting into trouble trying to do it. I suppose in the back of their mind they also perhaps worried about getting themselves into trouble, which in this state is not a stretch of the imagination.

          They were very quick to correct course and very apologetic. My sense is they are not fudders, they are just a gun shop in enemy territory and any slip up (real or perceived) could result in them running afoul of CA DOJ. It must be a living nightmare trying to operate a gun business in this state, I don't envy gun dealers here one bit.

          Also, gun dealers do not deal with this type of transfer - ever, so it is no surprise that they and their DOJ dealer reps don't know about it. These types of transfers only happen (and can only happen) at home.

          Anyhow I am not posting this to drag anyone, just trying to spread the word to parents and other gun dealers - you can still give your adult kids handguns in this state even if they are under 21.

            i but the question she missed was the same one i did

            it was (generally a person has to be 21 to purchase a rifle) being that i bought my first one when i was 18 i was unaware of the law change

              What does that have to do with firearm safety? Does the question specifically state in California? Otherwise, 21 is arguably not the correct answer.

                I will have to ask her, but I think the question she missed was related to felony and lifetime ban on possession.

                  That is such a common one for a first timer to miss. Doesn't seem rational. In society almost everything has a pathway to reconciliation.
