Can someone sell my guns on my behalf?

    Can someone sell my guns on my behalf?

    I moved out of state but left two long rifles at home in ca. can a family member sell them to a ca resident on my behalf?

    Two part answer.

    1) IMVHO, selling something one does not own, without explicit permission from the owner, is Not A Good Idea. Limited Power of Attorney is a solution, no need to show that to anyone unless something really weird happens.

    2) On a PPT, the owner is not checked, as there are so many guns in CA that are not in AFS, so that relative selling for you would almost certainly Get Away With It, but see (1).

      A couple of years ago I sold about 25 guns for a friend who's husband had passed away. No problems. All of the guns were so old that there was likely no official record of ownership. I suspect that DOJ was much more interested in who was buying than who was selling.

        They have my permission, I just didn’t have room to take 2 of my long guns with me when I moved so they are sitting in a family member’s safe until I either sell them, ship them to myself, or fly back and take them with me.

          I think the only time you might have an issue is if the buyer is flagged and the sell doesn't go through. But seems more likely for hand guns, im not sure but they might check ownership if they have to return it to you, mayby someomore knowledgeable knows.

          On long guns, there's so many out there that are legally owned but not registered in the owners names.


          But as mentioned, when you sell a firearm, they only check the gun to make sure it's not stolen, and check the buyer to make sure their not restricted.
