    PT trade questions???

    Any help with this will be much appreciated......

    Ok....I want to trade 3 pistols and a lower receiver to someone for 3 of their pistols...these are my questions

    How much should we be charged and do they go on one Dros for each person?

    Will this (flag) some multiple gun transfer with the ATF...and if so why??

    Are we both exempted from the 1 in 30 days and the new 11% tax?

    And lastly, I'm currently in the middle of perching another gun from a dealer..will that mess anything up with the PPT?...(I'm in the middle of my 10 day waiting and will be getting another gun as soon as my 1 in 30 is up???

    Any information on this mess isgreatly appreciated...thanks

    You should be charged no more than $37.19 for the DROS, plus $10 for each firearm.

    It should all go on one DROS. 1 in 30 does not apply to PPT's, unless inside the city limits of Los Angeles.

    Yes it will trigger a multiple gun transfer notice to ATF, as required by law. A copy also goes to the local PD.

    As long as the purchase and the PPT do not occur inside the city limits of Los Angeles, there should be no issues.

      Thanks.....should I or the other person Expect a visit from the ATF or local law enforcement ? and why... That seems kind of weird.... Any One ever have a visit after A multiple transfer?

        Not really.

        Since 1968, Federal laws require FFLs to report of multiple handgun acquisitions within a five business day period to the BATFE. [18 USC 923(g)(3)(A)]
        The majority of this is resolved/concluded behind the scenes and the transferee will not be contacted or made aware or know what's going on.
        If the reporting FFL provides additional indicators that the acquisitions are for resale, then BATFE may follow up by conducting further investigations into the transferee.
        By the time the transferee knows anything it going on is typically when the BATFE shows up to raid the transferee for being an illegal unlicensed firearms dealer.

          Thanks quiet.... So if I trade for these guns I can never sell them again..... Or I Would be considered
          A criminal for not being a licensed dealer...????? That's pure madness...

            No, no, none of the above. Except the "madness" part.

            Both CA and Feds have an idea of what triggers an investigation for dealing guns without a license. CA uses the 'less than 6 sales per calendar year' as the threshold. Feds used to say 'occasionally and without regularity', though I did read about some attempt to put a number on that... The proposed rule was put on hold by a judge in Texas - https://americanmilitarynews.com/202...sed-gun-deals/

            Even under the new Federal rule, you'd have to flip them within 30 days.

              When exiting CA last year after retiring, I sold multiple guns in short period of time, 20 in one ppt, 10 in one ppt, 5 in one ppt, and 6 in separate ppts. No one has of yet knocked on my door here. Maybe common sense prevailed if anyone reviewed the big picture they could see a guy turns 65 and retires, goes on Medicare and SSA and moves from CA hell to FL paradise - checks out, no further questions.

                Thank you everyone for the help on this... After contacting 4 ffl's, The fifth one Was willing to do everything for the mandated price And no tax...

                  So, in that small sample, 80% of CA FFLs either misunderstand the law, or (properly) fear unreasonable enforcement of the law.

                    Most of them went something like this.......... (ME) I'm a little confused on what the fees are..... It should be...

                    .$37.19..to the state
                    .$10...to the ffl
                    For each ppt..and no tax on ppt?

                    I have to add something for my time. Whether it's storage fee or otherwise. I'm not gonna go through the headache for $10. Nothing personal of course...If you find somebody who is interested in doing that, I would encourage you to use them. I would totally understand and do the same thing,

                    The part that this FFL missed, is that I was going to buy mor stuff from him and possibly do future business....but now...........no thanks.

                      I've learned to call around before using a FFL.... You'd be shocked at some of the wackadoodle things I've been told.... and yes, a lot of shops want to try to add fees (which I believe is ILLEGAL?) on top of the $37.19+$10 per firearm. I just hang up and move on. One sketchy place I called wanted $80 (!?!?!) on top of the DROS for "storage/handling"...

                      That's BEFORE one gets into firearms that might be seen as "scary" or that are not something a shop would see everyday, so they don't want to take the chance that they "get caught" with it in their shop... Even IF I KNOW that a firearm can be legally transferred, again I'll just move on.

                      Ammo PPT's? - fuggeddaboutit... for the pittance the state allows them to charge, they simply won't do 'em. I do know of ONE store that will (Sacramento area), but other than that ONE, haven't found ANY others.

                      California is a "state of madness", for sure, and complying with the laws and keeping them all straight is a full time job for a medium sized LAW FIRM, IMO. Our legislature goes out of their way to make otherwise law abiding citizens into criminals, while running REAL criminals through a "in by 9, out by 12" system. Then people can't seem to figure out why there is so much CRIME, and continue to vote for people who are clearly clinically insane (detached from reality).
