    UZI Question

    I own an UZI Model B, 16" barrel and with the metal folding stock. It was purchased and DOJ registered in 1991.

    I would like to one day give it to my son, but currently, am not legally allowed to.

    Because it is a Category One assault weapon, identified by name, if I were to make it featureless, would it still be an assault weapon, and not transferable?

    My understanding is that gun can't be transferred to anyone in CA. You can sell/give it to someone in another state, like your son if he is a resident of another state. It's banned by name so wouldnt matter if it was made featureless, it's still banned. When you die it will have to be moved out of state, turned in for destruction or maybe a CA dealer that can possess AWs can take it? Not sure on last part. That dealer still wouldn't be able to sell/transfer it to any CA resident. Its banned, banned is banned.

    Tell your son to become a resident of another state where there arent any "AW" laws.

          No.

          Making the firearm permanently inoperable (destroyed per BATFE specifications) is the only legal method to cause a make/model banned firearm to be eligible to be "featureless".


          A person who legally inherits/obtains a RAW must do one of the following within 90 days of taking possession of the RAW: [PC 30915]
          A. Make it permanently inoperable. [PC 30915(a)]
          B. Sell it to a CA FFL dealer with a valid assault weapons permit or to an out-of-state FFL. [PC 30915(b)]
          C. Be a FFL/SOT and obtain a valid CA DOJ Dangerous Weapons Permit for an AW. [PC 30915(c)]
          D. Transport it out-of-state for storage or to transfer it through an out-of-state FFL dealer. [PC 30915(d)]




          Penal Code 30915
          Any person who obtains title to an assault weapon registered under this article or that was possessed pursuant to subdivision (a) of Section 30630 by bequest or intestate succession shall, within 90 days, do one or more of the following:
          (a) Render the weapon permanently inoperable.
          (b) Sell the weapon to a licensed gun dealer.
          (c) Obtain a permit from the Department of Justice in the same manner as specified in Article 3 (commencing with Section 32650) of Chapter 6.
          (d) Remove the weapon from this state.

              IMI was the manufacturer.
              Action Arms in Philadelphia was the importer.

                You did not ask this and no one has mentioned it but I was not clear based on your original post if you registered this as an AW. When you say "DOJ registered" that may be what you mean but I have also heard people use similar language referring to the DROS. I have an older relative that has an old HK rifle (I believe an HK94). He did not register it as an AW because he was convinced it was "registered" when he bought it. If this rifle is not a RAW, then it is not currently legal regardless of how you obtained it. I am not meaning to be insulting, just want to avoid someone trouble if they were not aware.

                  What is it chambered in? 9mm, 41AE, or .45ACP?
                  Magazines for the latter two are getting hard to find, while the much more common 9mm mags are easy to find.
