    Transfer/registration of old purchase

    Im sure the answer is in this forum somewhere, just cant sus it out.

    A friend of mine . . . .
    Purchased a S&W revolver in 1988. Legitimate deal from a workmate.
    No transfer work done. Not needed back then, right?
    Recently checked CA ownership and is still with original owner.
    Now wants to get gun into current ownership. How to?

    Cant do regular ownership transfer. Original owner is long gone.
    Not an intrafamilial transfer. Not a Volreg.
    What to do?

    volreg 19 bucks. does nothave to prove ownership

      That transfer in 1988 was CA legal.

      It is legal to own an unregistered non-prohibited firearm in CA.

      If the current owner wants to register it, then they need to do one of the following:
      A. Submit a completed Firearm Ownership Report (BOF 4542A) to CA DOJ BOF.
      B. Go online to CFARS, then access CRIS to submit an online Firearm Ownership Report.

      Within 4-64 weeks of the payment for the report being cashed, CA DOJ BOF will mail an acknowledgement letter to the reporting party.
      ^Due to "COVID related delays", this may take 6-18 months.

          While a firearm need not be registered, as Quiet states, isn't there a code section under which what was chargeable as a misdemeanor becomes a felony if done with a firearm not regitered in the accused's name?

            Concealed carry: a misdemeanor if gun is registered to you, a felony if not.

              Yes there is. That is the case for Carrying a Concealed Weapon and also for Carrying a Loaded Weapon.

              Please see Penal Code section 25400(a)(6) for the concealed weapon penalty. Also note that the defendant must also have been in possession of ammunition for the weapon in order for the felony penalty to apply.

              Please see Penal Code section 25850(a)(6) for the loaded weapon penalty.

              While there is no requirement for the weapon(s) to be registered, it may be advantageous for them to be registered if there is the potential for the owner to be charged with either offense.

                Besides the sentence enhancer for being an unregistered firearm...

                In order to legally loan a handgun to a family member or spouse without having to utilize a CA FFL dealer to facilitate the loan, the handgun must be registered to the owner/lender. [PC 27880(f)]
