    Question about my gun rights/5250 hold

    Hello everyone,

    Here is my story. When I was 18 I went through a very violent home invasion that left me with PTSD. Unfortunately this lead to me being held in a mental hospital a year later at 19 by my abusive parents.

    I was originally a 5150, and the doctor held me an extra day for whatever reason and then let me go. I spent overall 4 days in the mental hospital. He started the 5250 certification process, however I never had a chance to any sort of hearing or place to defend myself because I was released before the actual certification hearing date.

    Because of what I went through, I really would like to have a gun so I can protect myself. However I am scared because the 5250 process was started I will have a permanent ban. I have contacted the hospital and for the most part they seem extremely uncooperative and I'm not sure how much a lawyer can help me. I'm really lost and if anyone has any sort of advice it would be much appreciated. I think its extremely unfair for a 19 year old to have a lifetime ban from a constitutional right without even so much as a hearing. I'm praying that because I did not have the hearing, I would still have my firearm rights.

    Find a lawyer who deals with mental health law and gun rights, that might be a tall order for existence, but that is the best course of action.

      Could a personal eligibility check from the DOJ help in this case? That should answer it I hope. Someone with more knowledge will be along shortly…..

        The OP needs a qualified lawyer and is best off not discussing his serious, personal, legal matters with a bunch of anonymous strangers in cyberspace.
