Can I loan handgun to StepDad /or Mom

    Can I loan handgun to StepDad /or Mom

    Can I loan my handgun to my StepDad or to my Mom to go to the shooting range? I have shot with him many times and he wants to go with my Mom alone.

    What about Ammo, can i give him some to shoot?

    I searched an believe the following but as most laws go, just want to clarify. The "StepDad" part is a little confusing vs Father... Regarding the Law, not him lol.

    1 - StepDad or Mom needs FSC
    2 - 30 day maximum?

      tag, does this apply to family only? can i still lend a pistol to a friend for 30 days? is it required that they have a FSC?

            Thanks Hermosa, it was more of a hypothetical. I had a friend recently almost have a break in late at night with kids home and I remember it was an option before the FSC. Idea was to give him something short term during the 10-day wait but he declined in the end. Does this apply to long arms? Can you still loan a rifle/shotgun to a friend for 30 days?

                Whoever is being loaned the firearm needs a valid FSC. [PC 27880(e)]
                ^If both, your mother and step-father will be possessing the firearm during the duration of the loan, then they both need a valid FSC.

                The duration of the loan can not last more than 30 days. [PC 27880(d)]

                Step-relations are included in the intra-familial loan exemption. [PC 27880(a)]

                Since the firearm being loaned is a handgun, then the handgun must be registered to you. [PC 27880(f)]



                Penal Code 27880
                Section 27545 does not apply to the loan of a firearm if all of the following requirements are satisfied:
                (a) The loan is to a spouse, registered domestic partner, or any of the following relations, whether by consanguinity, adoption, or steprelation:
                (1) Parent.
                (2) Child.
                (3) Sibling.
                (4) Grandparent.
                (5) Grandchild.
                (b) The loan is infrequent, as defined in Section 16730.
                (c) The loan is for any lawful purpose.
                (d) The loan does not exceed 30 days in duration.
                (e) Until January 1, 2015, if the firearm is a handgun, the individual being loaned the firearm shall have a valid handgun safety certificate. Commencing January 1, 2015, for any firearm, the individual being loaned the firearm shall have a valid firearm safety certificate, except that in the case of a handgun, an unexpired handgun safety certificate may be used.
                (f) If the firearm being loaned is a handgun, the handgun is registered to the person making the loan pursuant to Section 11106.

                  This exemption only applies to family members. [PC 27880(a)]

                  In order to legally loan a firearm to a friend, the loan must be done through a CA FFL dealer. [PC 27545]
                  ^(initial) Lender -> CA FFL dealer -(DROS/10 day wait)-> Lendee.
                  ^(return) Lendee -> CA FFL dealer -(DROS/10 day wait)-> Lender.

                  Exemption to this is...
                  ... You are physically present for the entire duration of the loan, which can not last for more than 3 days. [PC 27885]

                    For the intra-familial transfer of ownership (gift, sell, bequeath) exemption, it only applies to immediate family members. [PC 27875(a)(2)]
                    ^Grandparent, parent, child, and grandchild.

                    For the intra-familial loan exemption, it applies to additional family members. [PC 27880(a)]
                    ^Grandparent, parent, child, grandchild, siblings, step-relations, and spouse/registered domestic partner.

                      For the comment about loaning a firearm and you couldn't see why. Back when it was legal I loaned a friend a rifle that was in a higher caliber than he had for a hunt out of state. Other than the current legalities I have no problem loaning a rifle to a friend for his hunt.
