    Former Ca. Resident Moving back Question

    I will be moving back to Ca. San Diego Area in a few months, I left in August of 2017 and set up a residence, I purchased a few Firearms Inc. 2Sigs a P320 and a P938 which are not on the Roster for Ca. but I want to keep. I did not get around to Changing My DL From Ca.to New Mexico (days off during the week are rare), anybody out there ever hear of a case like mine? after reading the hundreds of posts regarding the Mindless drivel that is Ca. Gun Laws, I wanted some input. Thanks in Advance for Your time

    Lots of questions about how you are going to prove you were a legal resident of NM. Did you sign a lease/rent contract? Did you register your car there? Did you register to vote in NM? Where did you pay income taxes? Did you leave property in CA, did you claim a homeowner exemption in CA. When you moved was the job going to full time or did you/they know it was a temporary gig.

      Much depends on details of which some are why you left Ca, did you maintain a residence in CA while you were out of the state, why you are now returning, and any ties you kept up with CA after you moved out. If you have read many posts on the subject you should be aware of Vehicle Code section 12505's impact on PC 17000.

      ...
      (b) For purposes of paragraph (6) of subdivision (a):
      (1) Except as provided in paragraph (2), residency shall be determined in the same manner as is the case for establishing residency pursuant to Section 12505 of the Vehicle Code.
      12505.
      (a) (1) For purposes of this division only and notwithstanding Section 516, residency shall be determined as a person’s state of domicile. “State of domicile” means the state where a person has his or her true, fixed, and permanent home and principal residence and to which he or she has manifested the intention of returning whenever he or she is absent.

      Prima facie evidence of residency for driver’s licensing purposes includes, but is not limited to, the following:

      (A) Address where registered to vote.

      (B) Payment of resident tuition at a public institution of higher education.

      (C) Filing a homeowner’s property tax exemption.

      (D) Other acts, occurrences, or events that indicate presence in the state is more than temporary or transient.

      (2) California residency is required of a person in order to be issued a commercial driver’s license under this code.

      (b) The presumption of residency in this state may be rebutted by satisfactory evidence that the licensee’s primary residence is in another state.
      So it comes down to the facts of your circumstances. Note that I highlight the impact of having a permanent home AND principal residence as well as that of having satisfactory evidence that the licensee’s primary residence is in another state.
