First, I am a newbie here, so just wanted to say hello to everyone. So, I was just delayed on 13 April and I was going to get my handgun yesterday. After reading here, I am really disturbed that in the event it goes to undetermined, that I may never know why. I have never been convicted of anything, no open tickets,Honorably retired military in 2010, and I just had my background checked for my security clearance finalized last month. So, when I received my letter that my DROS was delayed I was in shock. I only know of one thing that could have delayed it, back in 2002 I was arrested for Domestic violence, my now ex-wife explained to the sheriff and detective that It a was misunderstanding and that her sister called the cops and not her, because her sister misunderstood her on the phone. Anyways, the DA did not picked up the case. I never even walked into a court room. I have handled firearms after that in the line of duty in the military. Anyways, I did request my live scan, because it's only money and if there is something on there, that should not be there I want to attempt to correct it. BTW, my wife get's her gun on Friday....sucks..lol Anyhow, I am just venting and just have to wait it out, I guess.

That could do it. You should contact the Sheriff's office to make sure your record of arrest includes a record of release. See PC 849.5. You might also ask for a certificate pursuant to PC 851.6 (b) and evidence that your arrest records (Sheriff and DOJ) are in compliance with PC 851.6 (d).First, I am a newbie here, so just wanted to say hello to everyone. Could also be a common name, which is delaying it.Comment

Ya I'm hoping it's a name thing and it get gets approved before may 6th. Way back like 20 years ago we had trouble registering a car in my name or something like that. Anyways, some guy same name, birthday and a couple digit off SSN from what I can remember had a warrant that came up under my record. Saving grace for me was I was over seas in the military, so it was taken care of on the spot.Comment

I am in the same boat OP, and I buy guns quite frequently.
Make sure your FFL will release the gun to you if your DROS is undetermined after 30 days.
Mine says they won't and I will probably have to get my money back or re-DROS the gun if I still want it.
Sometimes I think the DOJ randomly delays people because they are so overwhelmed and they can't actually handle the DROS workload.Comment

Search around. Bill Weise posted a memo to the California Firearm Dealers Association (or something like that) referencing a memo from a fireams attorney opining that unless the sales agreement provided that guns would not be delivered to undetermined buyers, the dealer can be sued for breach of contract should it fail to deliver to an undetermined.
