    DROS Question

    So my buddy and I were given a couple handguns by an old lady neighbor, she didn't want them and didn't have any family she wanted to give them to. She was in poor health and felt they would be better appreciated by us than a spoiled grandchild or just sold to some shmo. My buddy kept the Luger .22 and I took the Colt Series 80 .380. We didn't get a bill of sale nor did we transfer them into our names (our bad). Now she has passed, about a year now, and I would like to carry the Colt but it's not registered to me. How do I go about getting it registered to me so I can have it legit? Or is this gun going to have to be shoved in the safe forever?

    So how do I prove she is dead? My problem is, I can't prove she gave it to me other than my buddy as a witness.

      If the gun is older it probably isn't registered in anyone's name. Keep it separate and use another gun for ccw. Don't waste time dealing with the doj or making an issue where there is none.

          Being as his screen name suggests he is in LE maybe we shouldn't suggest he breaks laws. I believe doing that oplaw form to DOJ should clear this up.

            Lol! This gun is one of many that I need to register, the rest of them are from my father. Really, I don't care if the older ones are registered but I want them registered for the simple fact if they get stolen. Most of the guns were purchased and sold and resold prior to the 70's and probably do not have a name attached to them. I can provide a death certificate for my dad and that shouldn't be an issue. I just didn't know how to go about the whole thing when I had nothing.

              No paperwork on your dad is required. As long as you can write the word FATHER ..

                If his dad gave them to him pre 1992 no paperwork would be required.

                  I acquired them after 1992 but there are guns from the 1890's all the way to the early 1960's. A couple are family heirlooms (Winchester 1892 with 4 digit sn and photo of Great Grandfather with the rifle on the hillside of the Panama Canal as it is being built), some were collectibles (Colt Python from the 60's), and some just fun plinkers (Ruger Bearcat).

                      The ones made before 1899 are considered antiques and for legal purposes are not consided firearms.

                        If your neighbor was not your grandmother or mother and the transfer was not done through an FFL in accordance with PC 28050, the parties did not comply with 27545.

                        It was therefore an illegal transfer, and nothing that can be done now can make it into a legal transfer. You can't "un-ring the bell."

                          Both of those statutes were after the transfer was made so it looks like I'm in limbo with this. I guess I'll just throw it in the safe and contact DOJ or just never take it out anywhere. I would hate to have to turn the guns over to the Sheriff and have them destroyed, it seems like a stupid thing to happen but it appears I don't have much of a choice here.

                            So now for the next question, I have never purchased a handgun with a hunter safety course requirement, I have always used my LEO creds. What the hell do I put down in the box that asks for the course number? My guess is to leave it blank and attach a copy of my ID.

                              The transfer was before 1991? The requirement to use an FFL for almost all transfers was imposed then.

                              The PC for 'dangerous weapons' was renumbered for 2012 and after, but the content is the same. 'Use an FFL' used to be part of PC 12070.
