Marlin Model 60 illegal to bring into CA, correct? (No: .22 tube exempt from LCM)

    Marlin Model 60 illegal to bring into CA, correct? (No: .22 tube exempt from LCM)

    Someone is asking me if they can bring their Marlin Model 60 when they move to California. This is a tube-fed .22LR rifle with a 15-18 shot capacity in the tube.

    The >10 capacity makes it illegal to bring in, correct?
    My friends and family disavow all knowledge of my existence, let alone my opinions.

    Tube fed rimfire is exempt. OK to bring.

    Penal Code 16740 (was 12020 (c)(25)) defines "large capacity magazine"

    As used in this part, "large-capacity magazine" means any
    ammunition feeding device with the capacity to accept more than 10
    rounds, but shall not be construed to include any of the following:
    (a) A feeding device that has been permanently altered so that it
    cannot accommodate more than 10 rounds.
    (b) A .22 caliber tube ammunition feeding device.
    (c) A tubular magazine that is contained in a lever-action
    firearm.

      There might be some exceptions. You may want to see if the Sunnyvale & Los Angeles magazine bans cover tube fed rimfires.

        Exempt.

        Los Angeles (which isn't even in effect at the moment btw)

        (a) Definitions.
        (1) "LARGE -CAPACITY MAGAZINE" means any detachable

        Sunnyvale Municipal Code section 9.44.050
        (a) No person may possess a large-capacity magazine in the city of Sunnyvale whether assembled or disassembled. For purposes of this section, “large-capacity magazine” means any detachable ammunition feeding device with the capacity to accept more than ten (10) rounds, but shall not be construed to include any of the following:
        (1) A feeding device that has been permanently altered so that it cannot accommodate more than ten (10) rounds; or
        (2) A .22 caliber tubular ammunition feeding device; or
        (3) A tubular magazine that is contained in a lever-action firearm.
