    Caltrain, or Joint Powers Board (JPBX on the reporting marks) OWNS the tracks between San Jose station and San Francisco and runs via trackage rights between San Jose and Gilroy.

    Amtrak's Capitol Corridor and San Joaquin services are operated by Amtrak, equipment owned by the state of CA (CDTX on reporting marks) on operate via trackage rights on the BNSF and UP.

    Ace train is owned by a joint powers board made up of the counties it runs through, uses ACEX as it's reporting marks, and operates on the UP.

    I could go on and I'd really start to bore the S*** outta ya, but there is a LOT involved when it comes to who owns what and who operates on who's tracks and where it begins and ends.

    SO...........

    After all that we still can't answer any questions about legality of legal CCW on a train and I used to be locomotive engineer.

    Let me throw this monkey wrench question out there...

    IF someone was riding a Capitol Corridor train (equipment owned by Caltrans, operated by Amtrak) between Davis and Oakland (UP trackage), there is NO checked baggage service on the CC trains, and was carrying with a valid CCW, has one committed a crime?
    Metrolink does not own a lot of their tracks. They are either owned by bnsf or union pacific. Metro link is guaranteed track age rights and in some instances they are also responsible for the maintenance of the tracks. Violia is the the company with the maintenance contract in souther california. The railroads would not give or sell trackage rights especially when they are spotting customers on tracks that metrolink runs on. SCRRA which stands for southern California railroad authority is the entity that runs metrolink.

      Veola does NOT operate metrolink, that changed about 2-3 years ago. Amtrak operates Metrolink and the equipment is owned by SCRRA.

      Regardless,

      Is your CCW valid on Metrolink? How about the Sounder service?

      So far no one can answer these questions. I also would NOT look to the RR police to answer it either, most of them can't tell if a train is running east or west let alone which way their gun is supposed to go in their holster.

      If there is nothing that says I can't do it, I will not ask for further clarification because they will officially say no.

        How about drive a car and stay the fork off the trains? I rode trains all over Europe when I was stationed there. They ain't all that exciting to ride.

          Not true. Google North (and/or South) Carolina company police or private police. These are private security companies whose employees have full police powers on their clients properties.

              Congress's powers are enumerated in Article I section 8 of the constitution. That language about interstate, "for transportation or shipment in interstate or foreign commerce", is an attempt by congress to demonstrate that they have the power to make this law. Since the commerce clause has been interpreted so broadly, pretty much anything that could eventually make it into interstate commerce (like taking a gun on a train) can be regulated at the fed level. For laws based on the commerce clause it doesn't matter if you are actually transporting inter- or intrastate.
