    Denied?

    My wife was recently denied by DOJ when trying to buy a new handgun. The reason was for a battery charge. The only instance she was ever arrested was when she was 12 and it was for battery. Other than that no other contact with LE. She's now 28. My question is, do charges don when you were a minor count against you as an adult?

        The funny thing is, she was just approved for a ccw by the local sheriff's office.

            I would call DOJ for clarification. It could be one of those issues with there being no disposition in the court records or something like that.

                You are correct. Please check out Penal Code 27920. A juvenile conviction (or a "juvenile sustained petition" for the purists) for simple battery (242 PC) imposes a firearms disability to age 30.

                Please note that DOJ criminal history records are notoriously incomplete. They often lack case follow-up and disposition information. But they very rarely, contain incorrect information. If the OP's served time in a camp, I would have to infer that there was a conviction in her case (or "sustained petition" for the purists).

                It's kinda odd that a county would approve a CCW permit for a prohibited person. Rylan75 - Which county issued the permit?

                  So if the battery happened when you were 18....ie an adult if would be a 10yr prohibition. But cuz you're were a stupid kid at 12 you're prohibited for 18yrs?

                    Especially since, as a prohibited person, she apparently had no handguns to list on her permit.

                          Isnt that against the CCW rules? I thought all firearms listed on the CCW must be registered to the actual carrier?
