    Suppose your OLL is stolen...

    Suppose your legally configured OLL rifle is stolen, and is converted to an illegal AW (say, by shoving a 30rd mag in). If it is recovered in illegal configuration, would you be able to make a claim for its return, or would the cops get to declare it a nuisance and have it destroyed?

    the cops will give it back to you, and as you walk out the door put the cuffs on you for having a aw in your gun case.

      Are you sure you'd want it back? It would be very hard to prove it was legally configured before it was stolen. They might even try to pin an assult weapon charge on you.

          Reporting it's configuration (rra 16" upper, bullet button, 10rd mag, etc) upon being stolen. Then when it's recovered, "IF" they recognize it as yours via the parts, you're good to go. If it's got new parts, but the serial and make of the lower match but the upper doesn't, ask for the serial'd lower only. Not sure how that stuff works, but it seems logical to at least try that.

            30 round mag doesnt make an OLL an illegal AW.

              you should be ok
              they can pull the mag out prior to giving it back to you
              might take some pushing and prodding and even then you may be screwed

              My dad had a friend who's shotgun was stolen and then cut down below the legal limit
              they found it and didn't want to give it back but he persisted and they took the barrel off and gave him both the barrel and gun

                  When you report it stolen or lost, list all the attachments/descriptors (upper, optics, fake can, etc... including the "10 rd. .223cal. fixed magazine")

                    Stolen gun.

                    First thing I would do is talk to a competent gun attorney before picking gun back up.

                    May even be smart to pay attorney to come with you while you are picking gun up.

                      I guess it would be a good idea to take a bunch of digital pictures of all of your guns, and for those that are OLLs clearly show the compliance mechanism being used. ( For example, an angled shot showing the BB. )

                        I would just document ALL parts of the rifle and take pictures.

                        plus no officer will ever hand you a weapon with a mag in it. Its against policy and the mag is booked separate from the gun anyway. then when they bring the mag out and its not yours tell them.
