HOW ABOUT A CLASS ACTION LAWSUIT AGAINST THE STATE OF CALIFORNIA ? ? ? ?

I have recently asked a lawyer about this and to the best of his knowledge he believes that this would be an open and shut case to sue the state of California for infringing on our 2nd amendment ! ! ! We all need to take this battle to court and spank the people who have been taking advantage of us in this state once and for all and take our rights back ! ! ! It seems to me that all of us on here could ban together and take the fight to the Supreme Court and from what the lawyer was telling me we could file a In Forma Papauris for a 2nd amendment violation , which basically means no court costs & or fees 😉 I am really pumped about this , anybody have any input on this ? As I would love to hear more than just one opinion . Looking forward to hearing from my fellow CALGUN brothers ! ! !
A WELL REGULATED MILITIA , BEING NECESSARY TO THE SECURITY OF A FREE STATE , THE RIGHT OF THE PEOPLE TO KEEP AND BEAR ARMS , SHALL NOT BE infringed ! Amendment - II . I WANT MY COUNTRY BACK ! ! ! !

Tough to fight a state that don't care about our voting rights, let alone 2nd amendment rights. As I remember, the people of California voted on Prop 8 (marriage is between man and woman). But a year later, it seems our votes didn't matter. Minority rules in the Peoples Republic of Kalifornia.

You don't really need to boldface things. It's actually easier to read if you write in the normal font.

          Sure, I'll oblige.

Sure, it will be open and shut. You will open it. The state of California will move that it be dismissed with prejudice, on failure to state a claim, and lack of legal basis. The court will dismiss with prejudice. Meaning the case is shut, and you will lose.

Why do you want to file as a class action? You need to make exactly the same good arguments as an individual lawsuit.

and from what the lawyer was telling me we could file a In Forma Papauris for a 2nd amendment violation , which basically means no court costs & or fees
Are you poor? Meaning you have very little income and no assets? If no, you can not file In Forma Pauperis. Trying to do so anyhow will get the court really upset at you (I've seen people try it, they got drubbed).

My opinion: You need to ask your lawyer to go to the California bar association, and hand his bar card back. Because either you are making this up, or your lawyer doesn't have a clue. Anyone who practices law and gives such bad advice is a danger to self and others.

I can tell ya if Im ever victim of mass shooting and survive I will go after every single politician who violated my 2A rights to carry a weapon. Lawsuits must be started no matter unlikely they will turn out. This is a tactic of the left that has worked to their advantage more times than I can count. Lawsuits will cause change in laws

Someone needs to read those stickies and stop using boldface.

You don't actually state a complaint. Sue the state for what, exactly?

And the lawyer will work pro bono right? Court costs are very small compared to the price a lawyer is going to cost you. This guy saw you coming from a mile away. Besides you might have a case if the state failed due process other then that all hoops were jumped, "I"s dotted and "T"s crossed. Then good luck suing to get your retainer back.

Hey- if a class action lawsuit was all we needed and its just that easy, can someone tell me why it wasn't advanced 40 or 50 years ago?

Sometimes the law defends plunder and participates in it. Sometimes the law places the whole apparatus of judges, police, prisons and gendarmes at the service of the plunderers, and treats the victim -- when he defends himself -- as a criminal. Bastiat

You would appear to be a bit early to the party.

Please do look at the Heller and McDonald cases, linked in my signature, then read the very long thread at The Firing Line "Current 2A Cases", and then visit the 2A litigation and Legal Discussion forum here at Calguns.
