    DUI and guns in the house

    Question:

    "person A" owns firearms and live with their family member, "person B". "Person B" does not own firearms, but was just convicted of a DUI. What repercussions could come to "person A" and their firearms due to "person B" having a DUI? What could "person A" do to avoid these repercussions, if any?

        DUI should just be a misdemeanor so where would there be a problem? They aren't banned from even owning guns as far as I know. Is there more here you're not telling us?

            until sb755 passed, person "b" is not prohibited from firearm possession with a misdemeanor DUI conviction.

            just remember gun safety rule - don't mix guns and alcohol...

                      I was recently talking to a guy who got a DUI. There was no wreck or anything, I believe he was pulled over for a tail light and the cop asked if he had been drinking. He was honest and said he had a couple beers after work and the office gave him a breathalyzer. He bleew just over 08.

                      When he was given probation, the original papers said no fire arms and he told his lawyer he would refuse the terms. Long story short, he did not end up with a firearms prohibition during probation.

                      This was Santa Clara county.

                            The term is 'weapons clause' and if you have it they can get you over most anything, even a pocket knife. Most non-violent offenses won't have a weapons clause. I would be very surprised if they gave him one for a DUI unless it was an injury DUI or a DUI that involved something else, IE drug possession.

                              I have a friend (no really!) who has 2 DUI convictions. He just picked up a new XD a couple months back. I don't think "Person A" has to worry, especially if their guns are locked up anyway.
