    Purchase of C&R's Out Of State And Leaving Them There

    OK, I have another question for group opinion...........

    I am going to Washington soon to visit my mom. With my 03, I know that I can legally purchase items on the C&R even though I live in CA, but so maintain a room in WA (see below). My question is this:

    If I run across a gun on the C&R list that would not be legal in California, and yet I purchase it and leave it at my Brothers place (where I do maintain a room that I pay rent for, and that contains a gun safe with some guns in it that I bought in WA and left there when I moved back to California 16 years ago) would I be breaking any Federal Laws?

    I have talked to a few friends in WA who say it is fine, but other opinions are welcome (and I would like to hear them).

    Again, I am not trying to get around any laws or "cheat" the system. I am just curious.....

    Also I should say that I will once again be a WA resident within a year or so....

    I know these opinions are not a substitute for legal advice etc, etc, just curious..........

    as long as they are C&R, they are fine to purchase with your 03 IMO.

      Thanks for the reply. I was of the same opinion. I am seriously considering getting a WA ID when I go up there since I do maintain a "residence" there and do "live" there for a month or two at a time each year.

      I have seen a lot of posts from people who own houses in other states (primarily AZ it seems) and they dont seem to have a problem.

        You should get an 03 with your Washington address so you can get guns shipped directly there...just an idea : )

          there was a Costa Mesa man who purchased a bunch of guns in NV using a fake NV ID. He got busted a few years later by ATF, along with the dealer...

            Thats an idea... But can my 03 have 2 addresses on it? My move to WA is about a year away (unless things get too bad here), mainly due to our Doc's (we both have back problem from failed surgeries), and there are still some things I want to buy here (went ahead and got my CA COE last month as well)....

                It sounds like the firearms need to be stored at the address on the C&R license.

                "At the election of a licensed collector, the annual inspection of records and inventory permitted under this paragraph shall be performed at the office of the Attorney General designed for such inspections which is located in closest proximity to the premises where the inventory and records of such licensed collector are maintained." ATF 2005 Regulations page 18. (ATF Publication 5300.4) The licensed collector may also elect to have the inspection conducted at their home. "

                  I believe you will have to have two licenses and two bound books. You could transfer from one license to another (complete with logging in/out in your bounds books.)

                  There is a member here on this site (his username escapes me) who has something in his signature line explaining how to have two C&R licenses.

                    Yes you can have 2 C&R 03 FFL's; 1 in California and 1 in a different state.
                    You can be a legal resident of two states, you can buy guns in both of them, and you can have 2 C&R FFLs

                      WA id be considered fake since I have a residence there? Even have a lease agreement & rent receipts?

                        There is a premises associated with your license. That is where ATF expects your collecting activities to be.
