Director Of Minnesota Police & Peace Officers needs to learn a little law

Am I wrong or doesn't Federal Firearms Law require all handguns to undergo a NICS (or in our case DROS)?

In most states private party sales do not require a background check.

although the 40% number is pretty questionable.

His 40% number is pretty much BS though, it's closer to 8%

            40%?
The obvious flaw in his assertion is: if the private "transfer" is not recorded or checked how could he know how often it happens?

We don't really know what the figure is, but what we do know is that 100% of new firearms are purchased with a NICS check.

You don't hear that stat bandied about very much.

The 40% number IIRC came from a study a while back that said that 40% of guns are purchased at gun shows.

The flaw in this number (which still seems VERY high to me) is that FFLs are still required to do a background check in ALL states when they sell a firearm.

Very few of the firearm sales at gun shows are private party sales.

The stat regarding of 40% of gun sales being face to face is true-as of 1992.

The study was done during the first Clinton administration in reference to the Brady Law, which at the time was being debated as a proposal. Naturally today the figure is as relevant as cassette tapes, not that it stops the opposition one bit.

It's false. The real number is 14 to 22%, with a margin of error of 6%, so no more than 28% http://www.washingtonpost.com/blogs/...55e7_blog.html
                      Revolvers are not pistols

pistol nouna handgun whose chamber is integral with the barrel
Calling a revolver a "pistol" is like calling a magazine a "clip", calling a shotgun a rifle, or a calling a man a woman.

And that 40% was based on phone surveys where they asked people if they thought they purchased from an FFL. At that time (1992) there were a ton more home FFLs and many people were unaware that the guy who's garage they were in was an FFL.

I wouldn't consider it to be true in 1992. A poll conducted with 250 random people by telephone has got to have a huge margin of error.

I do agree that it's not relevant today (any more than it was in 1992)
