    Consignment sale of Handgun Trigger 30-day limit?

    Hi all:
    I was wondering if anyone knows if the consignment sale of a handgun by a dealer is considered by DOJ to be a "retail sale" which triggers the 30-day limit of PC section 12072 (a), or are these considered like private party transfers, which do not?

    Nope, 30 day limit doesn't apply.

      Thanks a lot for the prompt response - great forum, great group!
      The reason I asked was - I did a PPT not quite a month ago and wanted to look at one of Bullseye's consignment pieces - but didn't want to be embarassed if I wanted to buy the consignment gun !

        I thought that Federal law required a new 4473 and background check if the firearm was not transferred to the buyer within 30 days of the date on the original 4473.

          Hmm, I believe the context of the orig post was related to the "one 'new' handgun every 30 days" limit expressed in 12072(a)(9)(A) (whereas acquisition of PPT or inherited handguns is not limited by count or delays between acquisitions).

          That's the context of my reply; as to your separate concern... yes, if you purchase a handgun (regardless of new or via PPT) and let it sit at the FFL longer than 30 days you're gonna have to re-4473/re-DROS it again.
