Ok I must have misunderstood your post here:

I believe this would even include requiring that the gun be sold with factory magazines and not aftermarket magazines, since those were the mags with which the handgun was drop tested and certified prior to Rostering.
By aftermarket, you must mean Not OEM.

I know places like Bud's Gun Shop won't ship the exact same pistol that come with 12rd mags from the factory just without the mags.

I'm sure a private seller though wouldn't mind keeping the mags but is that legal? If the gun shipped with hicap mags but we have it shipped to CA without any mags?

Yeah, mags don't have to be included. However, you will need to bring or provide a mag at pick-up for your safety certification test.

It would be legal to ship to CA, fine. However I feel that at least one factory mag should be with the gun at the time of DROS (since a Rostered/ approved handgun was approved with a factory mag, and a gun without a factory mag is not in an approved/tested condition).

Yes, a mag is indeed needed for the safe handling demo.

However (aside from the safety demo, a separate matter of law) I have seen no DOJ exemption of mags not being included for regular (non-PPT) sales. I would like to hear of this if they have.

If they do approve guns to be sold by FFLs (again, non-PPT) without any mag being part of the deal (ie, guy goes home without any mag, or without a factory mag - two different situations) that raises a variety of interesting questions

            Just his situation.

HK marks the caliber of the handgun on the side of the slide and on the barrel.

              Chainsaw has a valid point.

I'd bet it'd be difficult & expensive though.
